ORDINANCE N j 1-0,6 AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR OTHER PURPOSES. WHEREAS, Mickey Powell has requested that his property, described below, be re-zoned so as to align the zoning classification with the proposed use of said property and be consistent with the Comprehensive Plan;and WHEREAS, the Batesville Planning Commission has conducted a properly advertised public hearing on January 13,2014;and, WHEREAS, the Batesville Planning Commission has reviewed the relationship of this property with the Comprehensive Plan and determined that proposed use would be consistent with said Plan; and, WHEREAS, the Batesville Planning Commission has recommended that the requested amendment to the Zoning Districts map be approved by the City Council. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS HEREBY AMENDED AS FOLLOWS: From Single Family Residential(R-1)to Community Commercial(C-1) A tract of land being a part of the NE 1/4,SW '/.,and a part of the SE 1/4,SW '/,, in Section 9,T13N,R6W, in the City of Batesville, Independence County,Arkansas,more particularly described as follows: Commencing at the southeast corner of said NE %<,SW '/<,thence N 88°42'26"W,along the south line of said NE 1/4, SW '/o,258.69 feet to the west right of way line of North Saint Louis Street(U.S. Highway No. 167)and the point of beginning. Said point is designated as Station 117+43.89 and 95.21 feet per construction centerline of AHTD Job N.050159;thence along said west right of way line, S 27°30'26"E, 27.78 feet to the northerly right of way line of Bluff Drive;thence along said northerly right of way line of Bluff Drive N 69°31'23" W, 178.80 feet;thence N 69°09'28"W,236.46 feet;thence leaving said right of way line,N 11°48'55"E,29.65 feet to the south right of way line of the Union Pacific Railroad;thence along said south right of way line of the Union Pacific Railroad along a curve to the right,said curve having a radius of 946.45 feet and an arc length of 260.85 feet and a long chord bearing of N 74°38'43"E, 260.03 feet to the west right of way line of North Saint Louis Street;thence along said west right of way line S 28023'07" E feet to the point of beginning.
