ORDINANCE NO.2013-07-_QL <br /> AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR <br /> OTHER PURPOSES. <br /> WHEREAS, a number of properties were annexed into the city of Batesville by Ordinance <br /> Number 2013-05-03; and, <br /> WHEREAS, the zoning classification of said annexed properties is automatically assigned as <br /> Single-Family Residential(R-1), regardless of their present or proposed use, pending review and <br /> recommendation by the Batesville Planning Commission of permanent classification; and, <br /> WHEREAS, the Batesville Planning Commission has reviewed the present and proposed uses of <br /> said properties, as well as their relationship with the Comprehensive Plan; and, <br /> WHEREAS, the Batesville Planning Commission has prepared recommendations to assign <br /> permanent zoning district classifications of General Industrial (I-2)to said annexed properties, consistent <br /> with the Comprehensive Plan, and conducted a properly advertised public hearing on June 24,2013. <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS <br /> HEREBY AMENDED AS FOLLOWS: <br /> Those properties whose zoning classification was Single-Family Residential(R-1) immediately after <br /> their annexation into the City of Batesville by Ordinance Number 2013-05-03,are hereby reclassified <br /> as General Industrial(1-2). <br /> IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD <br /> TO BE INVALID,SUCH INVALIDITY SHALL NOT AFFECT THE REMAINING PORTION <br /> OR PORTIONS OF THIS ORDINANCE. <br /> e, ea d <br /> 'f';e sred-the erderl+-edministretien of Bete^ " r'fi�r�e ran e+aer$enc3 is hPrPh + a st <br /> IT IS SO ORDAINED. <br /> r� <br /> IN WITNESS WHEREOF, we have set our hands thisk3 , day of . 2013. <br /> APPROVED: <br /> RICK ELUMBAUGH, MAYOR <br /> ATTEST: <br /> Lvr�_� W. pokAn- <br /> DENISE JOHNSTON, CNERK <br /> APPO ED S O LEGAL FORM: <br /> LIND S LE ERRY, CITY ATTORNEY <br />
