MINUTES OF COUNCIL <br /> SPECIAL MEETING <br /> NOVEMBER 20,2003 <br /> The Batesville City Council met in a special session on November 20, at 9:00 AM at the <br /> Municipal Building. Mayor Joe Biard presided over the meeting. Upon roll call the following <br /> Councilmembers answered present: Jim Cargill, R.L. Carpenter, Robert Ford, Gerald Gaither, <br /> Jim Mitchum, Jerry Pectol, Paula Terrell and Jim Watkins. Also present were the City Clerk <br /> Denise Johnston and the City Attorney Scott Stalker. <br /> CONSIDER AN ORDINANCE TO AMEND ORDINANCE #935 <br /> Councilmember Pectol introduced an ordinance that would amend ordinance 4935, <br /> Section 2, to give the Mayor authority to issue other exemptions if there is a reasonable need <br /> which will benefit the City of Batesville to shoot fireworks inside the city limits. The council <br /> discussed the issue and the Mayor made it clear that he would proceed with caution in a limited <br /> manner and this exception is to be truly an exception and not the general rule. This request is <br /> coming from Batesville High School who is in a state football playoff game on Friday, <br /> November 21 and would like to shoot fireworks during and after the game between 6:30 and <br /> 10:30 PM. Superintendent Ted Hall said the school has hired a professional company to set off <br /> the fireworks. Danny Russell, Assistant Fire Chief, said for safety purposes, 4 firefighters should <br /> be present at the fireworks site. Mr. Russell said that he had one on-duty firefighter that could go <br /> to the school but he would have to get 3 off-duty to assist firefighters. Mr. Hall said the school <br /> would pay for the off-duty officers. Councilmember Watkins moved to suspend the rules for the <br /> second and third readings and Councilmember Cargill seconded. The roll call count was 8 for <br /> and 0 against. Councilmember Watkins moved to adopt the ordinance and Councilmember <br /> Carpenter seconded. The roll call count was 8 for and 0 against.
