RESOLUT I ON NO. <br /> (W <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> BATESVILLE, ARKANSAS EVIDENCING A PRESENT INTENTION <br /> TO ASSIST WITH THE FORMATION OF A MUNICIPAL <br /> IMPROVEMENT DISTRICT. <br /> WHEREAS, Eagle Mouintain Joint Venture ( "Eagle Mountain" ) is <br /> the owner of cetain real property recently annexed into the City <br /> of Batesville, Arkansas; and <br /> WHEREAS, Eagle Mountain and certain other real property <br /> owners desire to establish a municipal improvement district <br /> pursuant to Arkansas Statutes Annotated §§20-101 et . seq. (the <br /> "Act" ) in order to facilitate the construction of certain public <br /> improvements , including particularly water systems, 'waste water <br /> systems , streets and roads; and <br /> WHEREAS, any indebtedness incurred to construct said <br /> improvements would be supported by property tax payments from <br /> properties enhanced by the construction of such facilities; and <br /> WHEREAS, the City of Batesville wishes to evidence its <br /> present intent to assist in the formation of said District . <br /> NOW THEREFORE, be it resolved by the City Council of the <br /> City of Batesville, Arkansas that the City hereby expresses its <br /> present intention to assist in the formation of said municipal <br /> improvement district, following the submission of the necessary <br /> documentation in form required by the Act and applicable law. <br /> Adopted this 11th day of June, 1985 . <br /> Mayo <br /> '�C VV✓✓ <br /> City Clerk <br /> LS E A L] <br />
