ORDINANCE NO. , <br /> AN ORDINANCE CLOSING BEAN STREET BETWEEN BLOCKS 2 AND 3 <br /> OF THE OLD TOWN ADDITION TO THE CITY OF BATESVILLE, ARKANSAS <br /> WHEREAS, a petition was duly filed by Independence County with the <br /> City Council of Batesville, Arkansas on August 12, 1996, asking the City to <br /> vacate and abandon all of Bean Street between blocks 2 and 3 of the Old Town <br /> Addition to the City of Batesville; and <br /> WHEREAS, after due notices required by law, the Council has heard all <br /> persons desiring to be heard on the question August 27, 1996, and has <br /> determined that the public interest and welfare will not be adversely affected by <br /> the abandonment of such street. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br /> BATESVILLE, ARKANSAS: <br /> SECTION 1. The City of Batesville hereby releases, vacates and <br /> abandons all its rights, together with the rights of the public generally, in and to <br /> the street designated as follows: <br /> Bean Street between Main Street and College Avenue that lies between <br /> blocks 2 and 3 of the Old Town Addition to the City of Batesville, Arkansas. <br /> SECTION 2. A copy of this ordinance duly certified by the City Clerk <br /> shall be filed in the office of the recorder of the County of Independence and <br /> recorded in the deeds of the County. <br /> SECTION 3. EMERGENCY CLAUSE: Whereas it is necessary to effect <br /> the public peace, health, safety and welfare of the City, an emergency is <br /> hereby declared to exist and this ordinance shall be in the full force and <br /> effective from and after its passage. <br /> IN WITNESS WHEREOF, we have set our hands this 27th day of August, <br /> 1996. <br /> APPROVge <br /> Biard, ayor <br /> ATTEST: <br /> Denise M.
