ORDINANCE NO. AN ORDINANCE GRANTING A FIFTEEN (15) YEAR EXTENSION OF AN ORDINANCE GRANTING A FRANCHISE TO COMMUNITY ANTENNA COMPANY, INCORPORATED, ITS SUCCESSORS, LESSORS AND ASSIGNS, A FRANCHISE, RIGHT AND PRIVILEGE TO USE AND OCCUPY FOR ITS TELEVISION SIGNAL SERVICE, THE STREETS, AVENUES, HIGHWAYS, BRIDGES, LANES, PUBLIC GROUNDS AND ALL PLACES WITHIN THE CITY OF BATESVILLE FOR THE PURPOSE OF ERECTING, CONSTRUCTING, OWNING, LEASING OR OTHERWISE ACQUIRING, MAINTAINING AND OPERATING TELEVISION LINES TO BE USED IN FURNISHING OR SUPPLYING THE MUNICIPALITY AND ITS INHABITANTS OR ANY PERSON OR CORPORATION WITH THE TELEVISION AND ANY OTHER SIGNALS, AND ALL ASSOCIATED BUSINESS NECESSARY TO THE OPERATION AND FULFILLMENT OF THIS ORDINANCE OR FRANCHISE. WHEREAS, the City Council of the City of Batesville, Arkansas, granted a Franchise to Community Antenna Company, Incorporated, to construct, operate and maintain a cable television system in the City of Batesville, Arkansas; and, WHEREAS, Community Antenna Company, Incorporated did transfer and assign to Teleservice Corporation of America, all its rights, title and interest in theFranchise, and, WHEREAS, Teleservice Corporation of America, Incorporated did transfer and assign to TCA Cable Partners all its rights, title, and interest in the Franchise; and, WHEREAS, TCA Cable Partners is requesting a fifteen (15)year extension of the existing Franchise; and, WHEREAS, the City Council of the City of Batesville, Arkansas has determined that granting TCA Cable Partners, a franchise extension is in the best interest of the citizens and residents of Batesville, Arkansas. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS THAT: Section 1. That all terms of the Franchise and amendment to the Franchise remain in full force and effect and except as herein specifically amended.
