ORDINANCE NO. q9- <br /> AN <br /> ORDINANCE RE-ZONING CERTAIN PROPERTY OF CHARLES GOFF FROM <br /> R-1 RESIDENTIAL TO COMMERCIAL C-2; DECLARING AN EMERGENCY AND <br /> OTHER PURPOSES <br /> BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS AS <br /> FOLLOWS: <br /> (1) The following city property be and the same hereby is rezoned from R-1 Residential <br /> to Commercial C-2; said property presently owned by Charles Goff was the petitioner <br /> for the said zoning classification change. <br /> (2) That the property is described thus: <br /> A tract of land being a part of the E 1/2 of the SW 1/4 of Section 15, T 13 N, R 6 W in <br /> the City of Batesville, Independence County, Arkansas, more particularly described as <br /> follows: commencing at the southeast corner of said E 1/2, SW 1/4;thence N 01 <br /> degree 42' 05"E along the east line of said E 1/z, SW 1/4, 1266.16 feet to the point of <br /> beginning (POB);thence N 87 degrees 42' 19"W, 374.07 feet to the Row property, <br /> thence N 01 degree 17' 32"E along said Row property, 525.0 feet; thence S 87 degrees <br /> 42' 19"E along said Row property, 255.0 feet; thence N 01 degree 17' 32"E along said <br /> Row property, 284.4 feet to the nominal west right of way line of Harrison Street;thence <br /> S 21 degree 29' 52"E along said right of way line, 316.92 feet to the east line of said E <br /> 1/2, SW 1/4 ;thence S 01 degree 42' 05"W, 519.32 feet to the point of beginning. <br /> Containing 4.92 acres, more or less. <br /> (2) It is hereby found and declared that an emergency exists and that this ordinance being <br /> necessary for the public welfare, it shall be in full force and effect from the date of its <br /> passage. <br /> PASSED AND APPROVED THIS 13THDAY OF JULY, 1999. <br /> ATTEST: <br /> - =nom- - - ----- ----------- -- --- --------------------- <br /> DENISE JOHNSTON, ONORABLE JOE BIARD, MAYOR <br /> BATESVILLE MUNICIPAL CLERK <br />
