• ORDINANCE NO. <br /> AN ORDINANCE RE-ZONING CERTAIN PROPERTY OF THE CITY <br /> OF BATESVILLE FROM R-2 RESIDENTIAL TO COMMERCIAL C-2; <br /> DECLARING AN EMERGENCY AND OTHER PURPOSES <br /> BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, <br /> ARKANSAS AS FOLLOWS: <br /> (1) The following city property be and the same hereby is rezoned from R-2 Residential <br /> to Commercial C-2; said property owned by the City of Batesville was the petitioner <br /> for the said zoning classification change. <br /> (2) That the property is described as thus: A tract of land being a part of the NE 1/4 of <br /> Section 21, T 13 N,R 6 W in the City of Batesville, Independence County, Arkansas, <br /> more particularly described as follows: Commencing at the northeast corner of said <br /> Section 21;thence N 90 degrees 00 feet 00inches W, 1337.85 feet;thence S 00 <br /> degrees 00 feet 00 inches W, 1726.74 feet to the point of beginning;thence N 64 <br /> degrees 05 feet 30 inches E, 138.85 feet to the nominal south edge of an asphalt road; <br /> thence along said nominal south edge the following;the following: S 65 degrees 57 <br /> feet 18 inches E, 11.71 feet; S 47 degrees 01 foot 15 inches E, 20.33 feet; along a <br /> curve to the left said curve having a long chord bearing of S 77 degrees 21 feet 21 <br /> inches E, a long chord distance of 51.81 feet;N 72 degrees 18 feet 32 inches E, 14.86 <br /> feet; along a curve to the right said curve having a long chord bearing of S 72 degrees <br /> 27 feet 30 inches E, a long chord distance of 16.35 feet; S 37 degrees 13 feet33 inches <br /> E, 72.58 feet; S 12 degrees 31 feet 24 inches E, 12.99 feet to the nominal north edge <br /> of a crushed stone drive;thence along said nominal north edge the following; S 37 <br /> degrees 11 feet 19 inches W, 33.77 feet; S 60 degrees 16 feet 20 inches W, 25.23 feet; <br /> S 12 degrees 44 feet 30 inches W, 56.03 feet; S 33 degrees 31 feet 55 inches W 21.12 <br /> feet;thence S 59 degrees 40 feet and 33 inches W, 97.91 feet to the nominal east face <br /> of a rock wall; thence N 32 degrees 05 feet 47 inches W, along said nominal east face <br /> and along the extension of said east face, 237.80 feet to the point of beginning. <br /> Containing 0.95 ACRES, more or less. <br /> (3) It is hereby found and declared that an emergency exists and that this ordinance being <br /> necessary for the public welfare, it shall be in full force and effect from the date of its <br /> passage. <br />
