CW1 • Section 26 . Anything herein to the contrary notwithstanding, all rights of any holder of any Bond to or with respect to any moneys or investments held in any fund hereunder shall terminate at the expiration of two years plus six months from the date of maturity of such Bond, whether by scheduled maturity or by call for redemption prior to maturity in accordance with the terms hereof . Section 27 . Nothing in this Ordinance expressed or implied is intended or shall be construed to confer upon, or to give to, any person or entity, other than the City, the Trustee, and the registered owners of the Bonds, any right, remedy or claim under or by reason of this Ordinance or any covenant, condition or stipulation hereof, and all covenants, stipulations, promises and agreements in this Ordinance contained by and on behalf of the City shall be for the sole and exclusive benefit of the City, the Trustee, and the registered owners of the Bonds . Section 28 . The provisions of this Ordinance are hereby declared to be separable and if any provision shall for any reason be held illegal or invalid, such holding shall not affect the validity of the remainder of the Ordinance . Section 29 . This Ordinance shall not create any right of any kind and no right of any kind shall arise hereunder pursuant to it until the Series 2001 Bonds shall be issued and delivered. (W Section 30 . All ordinances and resolutions or parts thereof, in conflict herewith are hereby repealed to the extent of such conflict . Section 31 . It is hereby ascertained and declared that the refunding of the 1995 Bonds is subject to interest rate fluctuations, which are beyond the control of the City. It is, therefore, declared that an emergency exists and this Ordinance being necessary for the immediate preservation of the public peace, health and safety shall take effect and be in force from and after its passage.
