i <br /> ORDINANCE NO. <br /> 1 <br /> AN ORDINANCE AMENDING THE CITY OF BATESVILLE ZONING CODE TO INCLUDE <br /> AN HISTORIC RESIDENTIAL DISTRICT DESIGNATION AND FOR OTHER PURPOSES <br /> WHEREAS, there is a need to preserve the character of historic residential <br /> districts within the City of Batesville and; <br /> WHEREAS, the current Zoning Code does not address or provide for an his- <br /> toric residential district; <br /> NOW THEREFORE BE IT ORDAINED by the City Council of the City of Bates- <br /> ville, Arkansas: <br /> The City of Batesville Zoning Code shall be, and is hereby, amended to in- <br /> clude an Historic Residential District designation within the R-1 District des- <br /> cribed in Section 5 of the City of Batesville Zoning Code. <br /> The Historic Residential District shall be known as an HR District. This <br /> district is comprised of an area where there are a significant number of his- <br /> toric structures used as residences. Such area will be no smaller than three <br /> (3) contiguous blocks, or six (6) contiguous half blocks. <br /> Historic structures are houses that were constructed prior to 1940 and <br /> are substantially in their original form at the time of the filing of the pe- <br /> tition as described below. <br /> In order to form an HR District or include land in an already designated <br /> HR District, a petition must be filed and notice must be given in the same <br /> manner as set out in the Code for a rezoning of property. This petition must <br /> be signed by at least 60% of the land owners who hold title to at least 60% of <br /> the land within the proposed district. <br /> Existing uses in the HR District may be continued even in the event of <br /> ® the partial or complete destruction of an existing structure. Provided, how- <br /> ever, if a historic structure within an HR District shall be used as a single <br /> family residence, then that structure may not thereafter be used for any pur- <br /> pose other than single family residential use. <br /> All other conditions and provisions of the R-1 District shall apply to <br /> the HR District unless specifically provided otherwise herein. <br /> Any and all ordinances or code provisions that are in conflict herewith <br /> are hereby repealed to the extent of the conflict thereof. <br /> APPROVED and ADOPTED this 2 n day of Cz= Ri c Q_ 1990. <br /> Jim Shirrell , ayor <br />
