• ORDINANCE NO. 90-12-1 <br /> AN ORDINANCE AMENDING ORDINANCE NO. 892 OF <br /> 1978 AS AMENDED; WITH RESPECT TO THE ESTAB- <br /> LISHMENT OF RATES FOR SEWER SERVICES; <br /> PRESCRIBING OTHER MATTERS RELATING THERETO; <br /> AND DECLARING AN EMERGENCY. <br /> WHEREAS, the Water Utilities Commission of the City of <br /> Batesville owns and operates sewage collection, pumping and <br /> treatment facilities (treatment works) ; and <br /> WHEREAS, in order to finance the proper and reasonable expense <br /> of operation, repair, replacements and maintenance and for the <br /> payment of sums required to retire the bonded debt of the treatment <br /> works; and <br /> • WHEREAS, it is necessary for the City to establish rates which <br /> will provide a more equitable share of total revenues from users of <br /> the treatment works; <br /> NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF BATESVILLE, ARKANSAS : <br /> Section 1 : That Ordinance No . 892, Section 5 (a) is hereby <br /> repealed and the following is substituted therefor: <br /> Sewer <br /> (a) The monthly rate for sewer services of the System <br /> shall be as set forth below for users located in the City. <br /> Monthly sewer charges shall be based upon water con- <br /> sumption. The Utilities Commission shall classify all users of the <br /> sanitary sewer system (user being hereby defined as any landowner <br /> whose buildings or premises are connected with and use the sanitary <br /> sewer system of the City or otherwise discharges sewage, industrial <br /> waste, water or other liquids either directly or indirectly into <br /> the sewer system of the City) as either domestic or commercial on <br /> the basis of whether the water consumption for the individual user <br /> is used for domestic or commercial purposes . In the case of <br /> domestic users, the average monthly water consumption for the <br /> months of January, February and March of the current year in which <br /> sewer bills are rendered and the month' s of October, November, and <br />
