or [� I ' ORDINANCE NO. - ��- An ordinance rezoning certain property in the City of Batesville, Arkansas lying in the Northeast Quarter of the Southwest Quarter of Section 13 , Township 13 North, Range 6 West in Independence County, Arkansas. WHEREAS , the City Planning Commission of the City of Batesville, Arkansas has conducted a public hearing on the petition of Daniel Cullum for the rezoning of certain property lying in the City of Batesville, Independence County, Arkansas , and the City Planning Commission has recommended to the Batesville City Council that the following described lands lying in Independence County, Arkansas , be rezoned from Residential R-2 to Commercial C-2 : Part of the Northeast Quarter Southwest Quarter of Section 13 , Township 13 North, Range 6 West more particularly described as follows : Commencing at the West Quarter Section Corner of Section 13 ; then run f South 87033 ' 29" East along the North line of the 460 Southwest Quarter of Section 13 1977 . 04 feet to the point of beginning; thence run South 2028 ' 31" West 349 . 98 feet to the North R/W line of Ark. Hwy. 69 ; thence run North 68050 ' 20" East along said North R/W line 148.47 feet ; thence run North 2028 ' 31" East 290 . 53 feet to the North line of the Northeast Quarter Southwest Quarter ; then run North 87033 ' 29" West 136 .02 feet to the Point of Beginning. WHEREAS , after due notices as required by law, the Planning Commission has heard all persons desiring to be heard on the question and has determined that the property ' s best use is for Commercial Community and that the property should be rezoned under the classification Commercial C-2 . That other property owners in the area will not be adversely affected by the rezoning and that the general public interest and welfare will not be adversely affected by said rezoning. • NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Batesville, Arkansas : ( 1 ) That the lands described herein shall be rezoned under the classification Commercial C-2 ; (2) A copy of the ordinance duly filed by the City Clerk shall be filed in the Office of the Recorder of the county and recorded in the Deed Records of the County.
