f 1W <br /> Page 42 <br /> 14 .2 Formula <br /> That from the date of passage of this ordinance to December 31, <br /> 1992 , the average cost per pound for treatment of suspended solids <br /> ( "TSS" ) shall be $0 . 0237 per pound; and the average cost per pound for <br /> treatment of concentrations having biochemical oxygen demand ( "BOD" ) <br /> shall be $0 . 1061 per pound. On and after December 31, 1992, and <br /> annually thereafter, the values for factors CSS and CBOD shall be <br /> determined as follows: <br /> CSS = Suspended Solids = 10% (total 0 & M costs) <br /> Cost Per Pound total pounds of S .S. treated in preceding FY <br /> CBOD = BODS Cost = 60% (total 0 & M costs ) <br /> Per Pound total pounds of BODS treated in preceding FY <br /> SECTION 15 - MISCELLANEOUS PROVISIONS <br /> 15 . 1 Charges and Fees <br /> Batesville Utilities Commission may adopt reasonable <br /> administrative charges and fees for reimbursement of costs of setting <br /> up and operating the Batesville Utilities Commission Pretreatment <br /> Program which may include: <br /> A. Fees for wastewater discharge permit applications including <br /> the cost of processing such applications. <br /> B. Fees for monitoring, inspection, and surveillance procedures <br /> including the cost of collection and analyzing an industrial <br /> user's discharge, and reviewing monitoring reports submitted <br /> by industrial users . <br /> C. Fees for reviewing and responding to accidental discharge <br /> procedures and construction. <br /> D. Fees for filing appeals . <br /> E. Other fees as the Batesville Utilities Commission may deem <br /> necessary to carry out the requirements contained herein. <br /> These fees relate solely to the matters covered by this <br /> ordinance and are separate from all other fees, fines and <br /> penalties chargeable by Batesville Utilities Commission. <br /> 15 .2 Severability <br /> If any provision of this ordinance is invalidated by any court <br /> of competent jurisdiction, the remaining provisions shall not be <br /> effected and shall continue in full force and effect. <br /> 15 . 3 Conflicts <br /> Ordinance No. 997 , and all other ordinances and parts of other <br /> ordinances inconsistent or conflicting with any part of this ordinance, <br /> are hereby repealed to the extent of the inconsistency or conflict. <br />
