- i <br /> (W <br /> • ORDINANCE 'NM. -j - Z <br /> AN ORDINANCE REDISTRICTING THE TIARDS OF THE CITY OF BATESVILLE, <br /> ARKANSAS , CHANGING BOU-MMARY LINES THEREOF , AND PROVIDING FOR <br /> AUTOMATIC EXP.,'?,NSION OF THOSE WARDS TO ADJACE*.T UNINCORPORATED <br /> AREAS IF ANNEXATION SHOULD OCCUR; DECLARING All E''?ERGET` CY AND <br /> OTHER PURPOSES: <br /> 1HEREAS , Act No. 253 of the 1983 Arkansas General Assemble, as <br /> codified in Ark. Stat. Ann. § 19-1005 , gives the City Council <br /> the authority to redistrict and change ward boundary lines , and; <br /> WHEREAS , the City Council of the City of Batesville, Arkansas <br /> has determined after due consideration, notice to the public and <br /> public hearings , that redistricting or changing of the ward <br /> boundary lines are necessary and further determine that the <br /> people of the City of Batesville can best be served b;% such <br /> redistricting or changing of ward boundary lines , and; <br /> WHEREAS , said redistricting would provide for equalization o= <br /> populization in the various wards and allow for expansion in <br /> each ward. <br /> BE IT ORDAINED BY THE CITY COUNCII, OF THE CITY OF BATESVILLE, <br /> • ARKANSAS: <br /> Section 1 : That the City of Batesville shall be divided into <br /> four (4) wards. That said wards shall be designated respectively ; <br /> as Ward 1 , Ward 2 , "s-'ard 3 and Ward 4 . The respective wards shall i <br /> consist of the areas designated, set forth and described on the <br /> official ward map of the City, a copy of which is attached <br /> hereto, marked EXHIBIT "A" and made a part hereof as though <br /> fully set out herein word for word, paragraph for paragraph , <br /> boundary for boundary, said _nap to be filed and maintained in <br /> the office of the City Clerk for the City of Batesville. <br /> Section 2 : The City Council shall , upon accepting any unincorpor-I <br /> ated lands into the Cite of Batesville shall at the same time ' <br /> designate which ward the newly added property will become a part <br /> of, taking into consideration natural boundaries and logical <br /> extensions of existing wards , equalization of population, actual <br /> or potential growth patterns of all wards , and other matters <br /> relevant to that decision; Once placed within a ,-.!ard the City <br /> Clerk shall then take the necessary and appropriate steps to <br /> include said area within the designated ward on the official map. <br /> Section 3 : If any part or parts of this ordinance shall be <br /> declared unconstitutional or otherwise unlawful by any Court of <br /> competent jurisdiction, then that part or parts of said ordinance <br /> declared to be unconstitutional or otherwise unlawful shall be <br /> severed from this ordinance and all other portions of this <br /> ordinance shall remain in full force and effect as if those <br /> portions declared unconstitutional or unlawful were never a <br /> part thereof. <br /> Section 4 : That a'_1 ordinances or parts of ordinances in conlic <br /> herewith are hereby repealed. <br /> Section 5: EMERGENCY CLAUSE: Whereas , the City Council finds <br /> that the Cite wards as now districted are not comparatively <br /> equal in population and further finds that some wards , as presentl'17 <br /> districted, have little if any area for expansion_ and, whereas , <br /> • the Cite Council finds that it would be in the best interest of <br /> the citizens of the CitN7 of Batesville to have more equally <br /> populated wards and in the citizen ' s best interest to have wards <br /> equally capable of expansion.; and, further, the City Council finds <br /> that ward redistricting_ should be done as soon as possible , in <br /> order for the citizens of Batesville to have equal representation <br /> in the impending elections , this ordinance is necessary for the <br /> preservation of the nublic ' s welfare and an emergency is hereby <br /> declared to exist anc this ordinance shall be in full force and <br /> ef"ect from and after its nassac-e. <br />
