ORDINANCE NO. AN ORDINANCE VACATING AND ABANDONING BALL STREET EXTENDED WHEREAS , a petition was duly filed with the City Council for Batesville, Arkansas on March 19 , 1984, as amended by a petition filed March 26 , 1984, asking the City Council to vacate and abandon Ball Street Extended in the City of Batesville, Arkansas, said street being hereinafter more specifically described ; and WHEREAS, after due notice as required by law, the Council has , at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained : • (1) That Ball Street Extended has heretofore been dedicated to the public use as a street hereinafter described ; (2) That all of the owners of the property abutting upon Ball Street Extended have consented to such vacation and abandon- ment ; (3) That said street has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of said plat of dedication, and , in fact, has never been opened to use by the general public since its dedication. (4) That the public interest and welfare will not be adversely affected by the vacation and abandonment of said street. (5) That Ball Street Extended is not required for any corporate purpose; and (6) That no public inconvenience will result from said closing. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS : Section 1. The City of Batesville, Arkansas , hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to Ball Street Extended in Batesville, Independence County, Arkansas, as hereinafter describel: (a) Ball Street Extended should be and hereby is described as all that portion of Ball Street bounded on the west by HLock 6 of Ball ' s Second Addition, City of
