ORDINANCE NO. <br /> AN ORDINANCE VACATING AND ABANDONING <br /> BALL STREET EXTENDED <br /> WHEREAS , a petition was duly filed with the City Council <br /> for Batesville, Arkansas on March 19 , 1984, as amended by a <br /> petition filed March 26 , 1984, asking the City Council to vacate <br /> and abandon Ball Street Extended in the City of Batesville, <br /> Arkansas, said street being hereinafter more specifically <br /> described ; and <br /> WHEREAS, after due notice as required by law, the Council <br /> has , at the time and place mentioned in the notice, heard all <br /> persons desiring to be heard on the question and has ascertained : <br /> • (1) That Ball Street Extended has heretofore been dedicated <br /> to the public use as a street hereinafter described ; <br /> (2) That all of the owners of the property abutting upon <br /> Ball Street Extended have consented to such vacation and abandon- <br /> ment ; <br /> (3) That said street has not been actually used by the public <br /> generally for a period of at least five (5) years subsequent to <br /> the filing of said plat of dedication, and , in fact, has never <br /> been opened to use by the general public since its dedication. <br /> (4) That the public interest and welfare will not be <br /> adversely affected by the vacation and abandonment of said street. <br /> (5) That Ball Street Extended is not required for any <br /> corporate purpose; and <br /> (6) That no public inconvenience will result from said <br /> closing. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br /> BATESVILLE, ARKANSAS : <br /> Section 1. The City of Batesville, Arkansas , hereby releases, <br /> vacates and abandons all of its rights, together with the rights <br /> of the public generally, in and to Ball Street Extended in <br /> Batesville, Independence County, Arkansas, as hereinafter describel: <br /> (a) Ball Street Extended should be and hereby is <br /> described as all that portion of Ball Street bounded on <br /> the west by HLock 6 of Ball ' s Second Addition, City of <br />
