ORDINANCE NO . <br /> AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE <br /> BIDDING FOR THE PURCHASE OF A USED BULLDOZER BY THE <br /> BATESVILLE UTILITIES COMMISSION , DECLARING AN EMERGENCY, <br /> AND FOR OTHER PURPOSES . <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, <br /> ARKANSAS, AS FOLLOWS : <br /> Section 1 : That pursuant to Section Five (5) of Act 28 of 1959 as <br /> amended by Section One (1) of Act 154 of 1979 , as codified in the <br /> Arkansas Statutes as Ark . Stat. Ann. 519-4425 the requirement of <br /> competitive bidding is hereby waived for the purchase of a used <br /> bulldozer by the Batesville Utilities Commission. <br /> Section 2 : That the City Council finds that this is an exceptional <br /> situation warranting waiver of bidding due to the non-feasibility <br /> and non-practicality of bidding on used bulldozers, due to the <br /> fact that each used bulldozer has particular characteristics <br /> unique to itself , and not, in this area, subject to bidding by <br /> specification, and the City Council finds that the Batesville <br /> Utilities Commission will be able to make a better financial deal <br /> without following the bid procedure. <br /> ® Section 3: EMERGENCY CLAUSE : That the City Council finds that <br /> the Batesville Utilities Commission may purchase a used bulldozer <br /> at a substantial savings if the bid procedure is not followed, <br /> and that the said savings is in the best interest of the City of <br /> Batesville and the Batesville Utilities Commission; that the <br /> Batesville Utilities Commission has an immediate need of a used <br /> bulldozer, and that this Ordinance is necessary for the promotion <br /> of the public ' s health, safety and general welfare, and an emer- <br /> gency is hereby declared to exist, and this Ordinance shall be in <br /> full force and effect as of the date of its passage. <br /> ADOPTED this day of )T/0, 1985 . <br /> APPROVED: <br /> IM SHIRRELL, YOR <br /> ATTEST: <br /> LARRY WIIJJAMS , CITY CLERK <br />
