4W <br /> ORDINANCE # ?S 0 -6 -Z <br /> AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE BIDDING CON- <br /> 4W THE BATESVILLE AVIATION COMMISSION' S PURCHASE OF A USED <br /> LOW-FREQUENCY SPECTRUM ANALYZER; DECLARING AN EMERGENCY AND FOR <br /> OTHER PURPOSES. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, <br /> ARKANSAS, AS FOLLOWS : <br /> Section l : That pursuant to Section Five ( 5 ) of Act 28 of 1959 <br /> as amended by Section One ( 1 ) of Act 154 of 1979 , as codified in <br /> the Arkansas Statutes as Ark. Stat. Ann. §19-4425 the requirement <br /> of competitive bidding is hereby waived concerning the purchase <br /> of one ( 1 ) Iiewlett Packard Model #3581A Low Frequency Spectrum <br /> Analyzer by the Batesville Aviation Commission from US Instrument <br /> Rentals , Inc. , of Richardson, Texas . <br /> Section 2 : That said Low Frequency Spectrum Analyzer is an item <br /> of used merchandise and as such the City Council finds that this <br /> is an exceptional situation warranting waiver of bidding due to <br /> the non-feasibility and non-practicality of bidding on used equip- <br /> ment; that the Batesville Aviation Commission has found that said <br /> used merchandise is the particular instrument which they need and <br /> is worth the puchase price of Three-Thousand Six-Hundred Dollars <br /> ( $3 , 600 . 00 ) . <br /> Section 3 : EMERGENCY CLAUSE: This purchase would be in the best <br /> interest of the public ' s health, safety and general welfare and <br /> the timeliness of said purchase being of the utmost importance <br /> and competitive bidding being non-feasible and non-practical and <br /> an emergency is hereby declared to exist and this Ordinance shall <br /> be in full force and effect from and after the date of its passage <br /> ADOPTED this �� day of 1986 . <br /> APPROVED: <br /> n.
