• ORDINANCE NO. ) �)� AN ORDINANCE SUBMITTING TO THE VOTERS OF THE CITY OF BATESVILLE, ARKANSAS AND OTHER AFFECTED PERSONS, THE QUESTIONS OF ANNEXATION TO SAID CITY OF BATESVILLE CERTAIN CONTIGUOUS TERRITORY. WHEREAS, it appears to the Council of the City of Batesville, Arkansas, that certain hereinafter described territory contiguous to the said City of ! Batesville is necessary for the orderly growth of said City; and, WHEREAS, the lands furnish the abode for a densely settled community or represent the actual growth of the municipality beyond its legal boundary; and, WHEREAS, the lands are needed for proper municipal purposes; now; THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, • ARKANSAS: Section l: That there shall be submitted to the qualified electors of the City of Batesville and of the following described area: All of Section 24; all of the Southeast quarter of Section 14; all of the Eastern Z of Section 23; all of the South- west quarter of Section 13, and all of that part of Section 13 commencing at the intersection point of the current Eastern boundary line of the City of Batesville, running North to a point where the Batesville City limit intercepts the Southern boundary line of the Missouri Pacific Railroad right-of-way thence running southeasterly along said Rail- road right-of-way line to the point where it intercepts the Western boundary of the City of Moorefield thence South to the Southern section line of Section 13, thence West to the point of beginning; all of said lands described herein lying in Township 13 North, Range 6 West, in Independence County, Arkansas; LESS AND EXCEPT that portion presently lying in the City limits of Batesville, Independence County, Arkansas. the question of the annexation of the above described territory to the City of QBatesville. Section 2. The question of annexation of the territory described herein shall be submitted to the electors qualified to vote on this issue at a special election to be held on August 2, 1988. The City Clerk shall immediately notify the County Election Commission by forwarding a certified copy of this ordinance. Section 3: If at such election a majority of the qualified electors vot- ing in such election shall vote for such annexation the municipality shall pro- ceed to file a description and a map of the annexed area with the County Clerk of the county wherein the land lies and with the Secretary of State.
