RESOLUTION NO. <br /> ,. A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AN INTERLOCAL <br /> AGREEMENT ON BEHALF OF THE CITY OF BATESVILLE FOR THE PURPOSE OF <br /> ESTABLISHING THE RESPONSIBILITIES AND OBLIGATIONS OF THE CITY OF <br /> BATESVILLE AND INDEPENDENCE COUNTY, REGARDING A 9-1-1 PUBLIC <br /> SAFETY COMMUNICATION CENTER, AND FOR OTHER PURPOSES . <br /> WHEREAS, the General Assembly of the State of Arkansas has <br /> enacted Act Number 683 of 1985 which provides for local political <br /> subdivisions of the State of Arkansas to create and fund 9-1-1 <br /> Public Safety Communications Centers for providing local <br /> emergency telephone service to the citizens within such political <br /> subdivisions; and <br /> WHEREAS, Act 742, Chapter 5, Section 90 of the 1977 Acts of <br /> Arkansas creates the authority for interlocal agreements between <br /> counties and municipalities within counties for legitimate public <br /> purposes; and <br /> WHEREAS, a majority of the persons in Independence County, <br /> by public election on November 4 , 1986 , have indicated their <br /> support for a 9-1-1 Public Safety Communications Center and have <br /> levied a 5% tariff on basic telephone rates to fund that center; <br /> and <br /> WHEREAS , it is necessary to set out the respective rights <br /> and obligations of Independence County, the City of Batesville, <br /> and the other incorporated municipalities within the county <br /> regarding the funding and operation of the 9-1-1 system; <br /> NOW, THEREFORE, BE IT THEREFORE RESOLVED that the Mayor s <br /> authorized to enter into an interlocal agreement with <br /> Independence County and the other incorporated municipalities <br /> within Independence County for the purpose of providing a system <br />
