BEFORE THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKA14SAS RESOLUTIO14 110__7U WHEREAS there exists some uncertainty as to the obligation of Community Antenna Company under its franchise with the City of Batesville , Arkansas to provide cable television service to the recently annexed area hereinafter particularly described; and WHEREAS the area involved is presently being served by Independence County Cable TV Company, Inc . , under a franchise previously granted by the City of Batesville ; Arkansas ; and fi WHEREAS in order to clarify the obligations of Community Antenna Company the following Resolution is hereby adopted by the City Council of the City of Batesville -, Arkansas . NOW, THEREFORE, in consideration of the premises it is hereby resolved by the City Council of the City of Batesville , Arkansas that : 1 ) The cable television franchise previously granted to Community Antenna Company, for the City of Batesville Arkansas , be, and hereby is , defined so as to exclude from Community Antenna Company ' s service area the following described portion of the City of Batesville , Arkansas : All that part of the City of Batesville , Arkansas lying South of State Highway 69 and East and North of State Highway 394 (formerly known as rap Road) , as said highways are presently located . 2) That the provisions of this Resolution shall not be applicable to the current customers of Community Antenna Company now residing within the excluded area above defined , provided, however, this exception shall not apply to any successors in interest to said present customers .
