L RESOLUTION NO. CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS WHEREAS, a majority of owners of the land hereafter described, both in number and in acreage, have petitioned the County Court of Independence County, Arkansas, for the annexation of said land to the City of Batesville, Arkansas, the said land being described more fully on Exhibit "A' attached hereto and incorporated herein by reference as if set out word for word and figure for figure; and, WHEREAS, after proper notice being published in accordance with the laws of the State of Arkansas, a hearing was held by said Court on the 29th day of October, 1980, and at said hearing the petition for annexation was granted and an order of annexation was entered on the 29th day of October, 1980, subject to acceptance by the City Council for the City of Batesville, Arkansas, and confirmation by the County Court; and WHEREAS, no notice of any proceeding to have the annexation prevented has been given to either the proper city authorities or the proper agents of the land owners within thirty (30) days frar!m the making of the Order of Annexation by the County Court; and WHEREAS, it is the opinion and belief of the City Council of the City of Batesville, Arkansas, that the annexation of the said land described herein would be in the best interest of the City of Batesville, Arkansas. BE IT THEREFORE RESOLVED, That the real property described herein should be, and it is hereby, incorporated into the City of Batesville, Ark- ansas; that the County Clerk is authorized to forward copies of this Resolution, along with other appropriate documents, to the proper officials; that upon the effective date of this Resolution the owners of the real property described herein shall have and enjoy all the rights and privileges as other residents of the City of Batesville, Arkansas.
