RESOLUTION # A RESOLUTION ADOPTING A POLICY OF PAYMENT TO OUTSIDE COUNSEL EMPLOYED BY EMPLOYEES AND OFFICIALS OF THE CITY OF BATESVILLE, ARKANSAS WHEREAS, there are few areas of personal liability on the part municipal officials and employees, and, WHEREAS, the City of Batesville, Arkansas participates in the Arkansas Municipal League Municipal Legal Defense Fund Program and also has the services of the Batesville City Attorney; and, WHEREAS , the City Council of the City of Batesville, Arkansas fin that in very few instances will there be a conflict requiring employment of outside legal counsel by officials and employees and it deems it necessary to issue a statement regarding the pay- ment of fees incurred without the council ' s prior approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS AS FOLLOWS: Section 1: That the City Council of the City of Batesville, Arkansas, having determined that, in most instances, the Arkansas Municipal League Defense Fund Program and the City Attorney of the City of Batesville, Arkansas will adequately provide legal representation to its employees and officials, adopts a policy of disapproving all bills and liabilities submitted to it without the official or employee to whom said services were rendered having first secured approval of said employment of outside counsel; that said employment will be provided if the City Council , prior to said employment of outside counsel, determines that the legal services it supplies are inadequate or if a real conflict arises necessitating the employment of outside counsel; however, the City Council, at the time of approval may set the maximum sum it will expend for said employment.
