At <br /> R E 3 0 L U T 1 0 N <br /> WHEREAS, Tom Choate, of Newport , Arkansas, has re- <br /> quested that he and his associates, successors, or assigns, <br /> be granted an exclusive right or franchise to serve the <br /> area in the City of Batesville, Arkansas, and all the <br /> inhabitants thereof with direct wire receptytl 6n.i.-, of tele- <br /> vision programs as relayed to his communityltelevision <br /> aerial from a connection with coaxial cablesat nearby <br /> points; AND, i <br /> WHEREASI , this service is a needed convenience for <br /> the City of Batesville and its inhabitants; AND, <br /> 1-1HEREAS, a definite commitment from the City of <br /> Batesville is necessary before Choate, his associates, <br /> successors, or assigns , can commit themselves financially <br /> for the installation and construction of the� utility; AND, <br /> WHEREAS, It is not possible to define as definite- <br /> ly as is desirable the exact terms of the franchise; NOW <br /> THEREFORE, <br /> BE IT RESOLVED That, for and in consideration of <br /> Ten Dollars ($10.00) and other good and valuable consid- <br /> erations, receipt of all of which is acknowll dged, the <br /> City of Batesville hereby grants to Tom Choate, his succes- <br /> sors or assigns , the exclusive right to serve the people <br /> of Batesville with direct wire reception of t1elevision <br /> programs as relayed to a Batesville installed, community <br /> television aerial for a term of (5) Five years <br /> from this date, and the officers of the City are directed <br /> to negotiate with Choate a detailed franchisejcontract <br /> incorporating these terms and submit to the City Council <br /> for approval, which contract shall provide th t the said <br /> Choate shall commence construction within <br /> months , shall commence the furnishing of serv�ce within <br /> months, and if at any tim� service is <br />
