RESOLUTION OF THE CITY COUNCIL <br /> OF THE CITY OF BATESVILLE,i <br /> ARKANSAS ADOPTED AT A REGULAR <br /> MEETING OF THE CITY COUNCIL <br /> HELD AT CITY HA L ATESVILLE, <br /> ARKANSAS, O _�t 1966 <br /> WHEREAS, Roe M. Bracy and Florence E. Bracy, his wife, are <br /> the owners of Lot 6, Block 4, East End Heights Addition to the <br /> City of Batesville, Arkansas, according to the Amended Plat of <br /> said East End Heights Addition appearing in Deed Record Book E-6, <br /> Page 153 of the records of Independence County, Arkansas, and <br /> WHEREAS, the improvements located on said property consist, <br /> among other things, of a house and carport attached thereto and <br /> r a recent survey of said property shows that the carport located <br /> thereon extends 3-1/� " ') feet over onto the right-of-way of Maple <br /> Street, and <br /> WHEREAS, the extension of said carport 3-1/ '. ' , feet over <br /> onto the right-of-way of Maple Street does not interfere with the <br /> use of Maple Street by the city or the general public and does not <br /> adversely affect the interest of the City of Batesville or the <br /> general public and the City of Batesville has no objection to the <br /> encroachment of said carport on the Maple Street right-of-way as <br /> shown by the above mentioned survey. <br /> NOW, THEREFORE, be it resolved that : <br /> The City of Batesville condones the encroachment of the <br /> carport onto the Maple Street right-of-way as set forth <br /> above as long as the present building is in existence <br /> but, should the existing structure be torn down, the <br /> City reserves the right to prevent any new structure <br /> from encroaching onto the Maple Street right-of-way. <br /> May-0'r, <br /> ATTEST: <br /> I <br /> City Cle <br />
