.;`A � � <br /> e •25OLv�ioir <br /> t <br /> 'ILI <br /> { <br /> Y' <br /> Legal Report (Cont'd) , Par 2.g. <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> BATESVILLE, ARKANSAS, APPROVING THE GENERAL <br /> URBAN RENEWAL PLAN AND THE FEASIBILITY OF RELOCATION . <br /> FOR THE NEIGHBORHOOD DEVELOPMENT PROGRAM <br /> OF BATESVILLE, ARKANSAS <br /> AND APPROVING THE FILING OF AN APPLICATION OR APPLICATIONS FOR FINAN- <br /> CIAL ASSISTANCE FOR THE CARRYING OUT OF A NEIGHBORHOOD DEVELOPMENT <br /> PROGRAM AND THE ANNUAL INCREMENT COVERED THEREBY ,. <br /> 4 <br /> 3 }- <br /> WHEREAS, under the provisions of Title I of the Housing Act of <br /> z 1949, as amended, the Renewal Assistance Administrator of the Dept. <br /> of Housing and Urban Development is authorized to provide financial <br /> assistance to Local Public Agencies for undertaking and carrying out <br /> urban renewal projects ; and <br /> WHEREAS, it is provided in such Act that contracts for financial <br /> aid thereunder shall require that the General Urban Renewal Plan for <br /> the Neighborhood Development Program area be approved by the governing <br /> body of the locality in which the project is situated and that such <br /> approval include findings by the governing ` body that: ( 1 ) the financial ' <br /> aid to be provided in the contract is necessary to enable the project <br /> ' + to be undertaken in accordance with the General Urban Renewal Plan; <br /> (2) the General Urban Renewal Pian will afford maximum opportunity, <br /> consistent with the sound needs of the locality as a whole, for the <br /> rehabilitation or redevelopment of the urban renewal area by private <br /> enterprise; (3) the General Urban Renewal Plan conforms to a general <br /> plan for the development of the locality as a whole; and (4) the <br /> General Urban Renewal Plan gives due consideration to the provision of <br /> adequate park and recreational areas and facilities , as may be <br /> desirable for neighborhood improvement, with special consideration <br /> for the health, safety and welfare of children residing in the general <br /> vicinity of the site covered by the Plan; and <br /> WHEREAS, it is desirable and in the public interest that the <br /> Urban Renewal Authority of the City of Batesville, Arkansas (herein <br /> called the Urban Renewal Authority) undertake and carry out the General <br /> Urban Renewal Plan (herein called the "Plan" ) identified as the <br /> General Urban Renewal Plan for the Neighborhood Development Program of <br /> Batesville, Arkansas , encompassing the area as described by the <br /> attached description in the City of Batesville, State of Arkansas <br /> (herein called the "Locality" ) ; and <br /> WHEREAS, the Urban Renewal Authority has applied for financial <br /> .assistance under such Act and proposes to enter into a contract or <br /> . contracts with the Department of Housing and Urban Development for <br /> the undertaking of, and for making available, financial assistance <br /> for, the Project to permit the carrying out of a Neighborhood Devel.o_- <br /> ment Program and the annual increments covered thereby; and <br /> WHEREAS, the Urban Renewal Authority has made detailed studi,es�" <br /> of the location, physical condition of structures , land use, environ- <br /> mental influences and social , cultural and economic conditions of the <br /> project area and has determined that the area is a slum and blighted <br /> area and that it is detrimental and a menace to the safety, health <br /> - -- --and--welfare of the inhabitants and—users thereof, and of the locality <br /> at large because the area substantially contributes to the increased <br /> spread of disease and crime, constitutes an economic and social <br /> liability -imposing onerous burdens which decrease the tax base and <br /> reduce tax revenues, substantially . iiapa-i r and rrest sound urban <br /> growth, retards sound economic. devel,opment, 'agravate traffic problems <br /> and substantially, impair and arrest eliminatio of traffic hazards <br /> I and the improvement of traffic facilit *s; tha the prevention and <br /> elimination of blight is a ratter of 04.1icy and concern; and the <br /> members of this City Council have been fully apprised by the Urban <br /> Renewal Authority and ?are aware of theses facts 'and conditions; and <br /> t Y ; <br /> ND .6-01• . <br /> ;. <br /> Zle <br />
