i <br />� \ <br /> > <br /> ` <br /> ` <br /> N� INTERLOCAL COOPERATION AGREEMENT ! <br /> THIS INTERLOCAL COOPERATION AGREEMENT is entered into by and between the sub- <br /> scribing public agencies pursuant to the provisions of the °|ntor|omm| Cooperation Act ' (Act No. ' <br /> 430ofthe Acts ofthe General Assembly of the State of Arkansas for the year 1987; Sections <br /> 14'901 to 14-908. inclusive, Ark. Stats.), in order to enable such agencies to engage in joint or <br /> cooperative action. � <br /> WITNESSETH: . <br /> 1. The duration nfthis agreement shall be perpetual so long as governments representing at <br /> least 75 percent of the population of this state planning region shall, on an annual basis, <br /> redesignate the use of this agreement to carry out the purposes described within. <br /> 2^ The precise organization, composition and nature of the criminal justice | icouncil <br /> cremtedrorzn in detail in the designated and adopted' by the members of the entity created hereby, true copies ofwhich � <br /> are attached hereto and made part hereof as Exhibit 1. <br /> 3. The purpose of the agreement is to implement | } wti | n i councilJust, � <br /> -a-ftiAg Regio <br /> to be known as White P.iver Criminal I — <br /> to the end that the following purposes shall be accomplished by said council: To <br /> encourage and permit local units of government to join and cooperate with one another <br /> to improve the criminal justice and law enforcement system within their areas; to plan for <br /> the future development of the region to the end that the operations of the criminal <br /> justice |exvVfonuannentaVoternn may be more carefully planned; that the cmmmnnuoities, <br /> -area d region, be provided with adequate criminal justice an ieuend personneland <br /> other anoantie| facilih ^es' that the needs ofthe various orirninm| justice and |avvmnfmroemnent <br /> �0�' agencies ofthe community, area and region be promotive ofthe efficient and economical <br /> use of public funds; to receive and expend federal and other funds; contract with the <br /> statornentand, as appropriate, among other units ofgnvernnnen1' private concerns <br /> or individuals for the performance of planning work. And, specifically, this entity shall <br /> have the duties and functions as provided in the Omnibus Crime Control and Safe Streets <br /> /\ut of 1888' as mnnended, as required by the state administering agency. This entity shall <br /> also have the powers, duties and functions as provided in Act 430mfthe Acts of the <br /> General Assembly of the State of Arkansas for the year 1967, insofar as they relate to <br /> carrying out the above-stated purposes, in connection with the preparation of the <br /> necessary studies and plans, and informing the public and promoting public interest and � <br /> understanding, and in making efficient planning recommendations to the members of the <br /> entity; and in assisting its nnernbor« in carrying out any necessary area plan developed by <br /> thentit' and in assisting any of the members ofthe entity or other public bodies in the <br /> preparation oreffectuation of necessary imuai plans consistent with the program and rnweny . <br /> or the entity, including the provision of administrative machinery for the coordination of ' <br /> programs by all or any members ofthe entity. <br /> 4. The manner mffinancing the joint or cooperative undertaking and of establishing and <br /> mnaintaininga budmeL 'therefore, shall be primarily ofstate and federal funds' the details <br /> of which are set forth in the by-laws. <br /> 5. The permissible method or methods to be employed in accomplishing the partial or com- <br /> plete termination of this agreement and for disposing of <br /> mrn'p|eteLerminatimnof1hismgreamontondfordioposingVf property upon such partial or <br /> complete termination are that upon dissolution of said council as provided by the 6«- <br /> |evvo, this agreement shall terminate, and in that event any property shall be disposed of, <br /> after paying off the debts ofthe council, bvdistribution tothe n of the state oro ' <br /> regional <br /> - ' recognized by the ,eno of the state as being responsible for carrying <br /> (W out the |"^a| and """`e orini 'al justice planning program under the Federal Omnibus <br /> Criminal Justice and Safe Streets Act of 1868, as amended. <br /> ' <br /> 8.
