EASEMENT DEED (W This. Indenture made this — day of 1974, between the CITY OF BATESVILLE, ARKANSAS, a municipal corporation, (here- inafter called "GRANTOR") , and the UNITED STATES OF AMERICA (hereinafter called "GRANTEE") . WITNESSETH: That the GRANTOR, for and in consideration of the sum of ONE AND NO/100 DOLLAR ($1.00) cash in hand paid, the receipt and sufficiency of which is hereby acknowledged and the benefits to be derived by GRANTOR, does hereby grant, bargain,n, sell and convey unto the UNITED STATES OF AMERICA and its assigns, a perpetual easement for the installation, maintenance and repair of a retaining wall, on, over, in and under the following described lands situated in the County of Independence, State of Arkansas, to wit: An easement 1.0 inches of uniform width along the -northwestern C, side of Boswell Street for so much of the distance along Block 4 of School Addition as fronts Lots 6, 7 and 8 of Block 4 of School Addition to the City of Batesville, Independence County, Arkansas, beiza; -more particularly de- scribed by metes and bounds as follows: BEGINNING at the Southwest corner of Block 4 of the School Addition to the City of Batesville, Independence County, Arkansas; THENCE N 540 471 0011 E, along the Southwest line of said Block 4, a distance of 208.71 feet to a point for corner; THENCE S 350 261 3011 E, a distance of 0.833 feet to a point for corner; THENCE S 540 471 0011 W, a distance of 208.71 feet to a point for corner; THENCE N 350 021 0011 W, a distance of 0.833 feet to the point of beginning and containing 173.86 square feet of land. 10 HAVE AND TO HOLD the said rights and easements unto the UNITED STATES OF AMERICA and its assigns forever; and GRANTOR does hereby warrant (W the title to same.
