Upon returning from execution session, Councilmember Insell moved to <br /> appoint Mrs. Miriam Lee and Mr. Mark Skelton to the planning commission. At <br /> the last meeting, the council adopted an ordinance to increase the planning <br /> commission from 5 to 7 members. Mrs. Lee's term will be a 4 year term from <br /> 6/10/99 through 6/10/03. Mr. Skelton's term will be a 5 year term from 6/10/99 <br /> through 6/10/04. Thereafter, the appointments will both be 5 year terms. <br /> Councilmember Gaither seconded the motion and all voted for. <br /> APPOINTMENT OF NEW ASSISTANT FIRE CHIEF <br /> Mayor Biard announced the appointment of Mr. James Boothby as the <br /> new Assistant Fire Chief. Mr. Boothby will replace Mr. Keith Stroud who passed <br /> away this past June. <br /> MAYOR'S ANNOUNCEMENT'S PART 2 <br /> Mayor Biard said lawsuit has been filed against the City of Batesville and <br /> several other cities regarding the sidewalks in the City not being in compliance <br /> with the American's With Disabilities Act. The Mayor said the City Attorney and <br /> an Attorney with the Arkansas Municipal League are working on the suit. The <br /> Mayor said the city is looking at a 5 year plan to improve the sidewalks. The <br /> Mayor also said he will keep the council up to date with the lawsuit. <br /> The mayor said an Interlocal meeting has been scheduled for August 30th <br /> at 3:00 P.M. at the Municipal Courtroom. The mayor said that we currently have <br /> four councilmembers on the liaison for the interlocal committee but the <br /> agreement only requires two member from the council. The Mayor asked for <br /> Councilmen Cargill and Insell to serve on the committee. <br />
