ORDINANCE NO. -'20 <br /> AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE <br /> THE CITY OF BATESVILLE TO PURCHASE OR LEASE A FRONT LOAD <br /> REFUSE COLLECTION TRUCK FROM ARKANSAS MUNICPAL EQUIPMENT, <br /> INC. <br /> WHEREAS, the Batesville Sanitation Department is in need of a new front <br /> load refuse collection truck for the collection of garbage, waste, trash, and refuse; <br /> WHEREAS, the Batesville Sanitation Department requires that said track <br /> meet certain specifications; <br /> WHEREAS, the Batesville Sanitation Department does not have a back up <br /> front refuse collection truck should one of trucks become disabled, as such the <br /> department's need for said truck is immediate; <br /> WHEREAS, the City of Batesville Sanitation opened competitive bidding <br /> on the same type of truck on August 5, 2015 with Arkansas Municipal <br /> Equipment, Inc. winning the bid at a price of $216,900; <br /> WHEREAS, Arkansas Municipal Equipment,.Inc. is now offering the same <br /> purchase price for this truck as it did in August of 2015, therefore it would not be <br /> practical to open up said purchase to competitive bidding given the short period <br /> of time since the last purchase; <br /> WHEREAS, Arkansas Code Annotated § 14-58-303 allows this governing <br /> body by ordinance to waive the requirements of competitive bidding in <br /> exceptional situations where bidding is deemed not feasible or practical; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br /> BATESVILLE, ARKANSAS: <br /> Section 1. That the Batesville Sanitation Department needs to purchase <br /> a new front load refuse collection truck. <br /> Section 2. That said truck is to be purchased from Arkansas Municipal <br /> Equipment, Inc. for the approximate sum of $216,900, more or less. <br /> Section 3. That because Arkansas Municipal Equipment, Inc. is offering <br /> the truck at the same price it won a competitive bid held on behalf of the City of <br /> Batesville for the same type truck in August of 2015, and because the <br /> department's need is immediate, competitive bidding is deemed to not be <br /> feasible or practical and is hereby waived. <br />
