ORDINANCE NO. 2016-05-DL <br /> AN ORDINANCE TO AMEND CHAPTER 14.14 OF THE BATESVILLE ZONING CODE; TO <br /> CLARIFY THE PURPOSE AND INTENT OF REGULATING SIGNS WITHIN THE CITY OF <br /> BATESVILLE;TO ENSURE CONSISTENCY WITH RECENT SUPREME COURT DECISIONS; <br /> AND FOR OTHER PURPOSES. <br /> WHEREAS,certain provisions of the Batesville Zoning Code,and more specifically Chapter 14.14, <br /> regulate the placement of signs within the City of Batesville; and, <br /> WHEREAS, it is the desire of the City Council of the City of Batesville to ensure that regulations <br /> governing signs within the City comply with First Amendment interpretations of the United States <br /> Supreme Court; and, <br /> WHEREAS,the Batesville Planning Commission has prepared recommendations to revise Chapter <br /> 14.14 in order to comply with the Court ruling,and conducted a properly advertised public hearing on <br /> April 4,2016, <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> BATESVILLE,ARKANSAS THAT CHAPTER 14.14 OF THE BATESVILLE ZONING CODE IS <br /> HEREBY AMENDED AS SHOWN IN ATTACHMENT A HERETO. <br /> IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD TO <br /> BE INVALID,SUCH INVALIDITY SHALL NOT AFFECT THE REMAINING PORTION OR <br /> PORTIONS OF THIS ORDINANCE. <br /> EMERGENCY CLAUSE: Whereas it is necessary to protect the First Amendment rights of the <br /> citizens of Batesville,and to ensure that the City is in compliance with federal court rulings at the earliest <br /> possible time,an emergency is hereby declared to exist and this Ordinance shall be effective from and as <br /> of its passage. <br /> IT IS SO ORDAINED. <br /> IN WITNESS WHEREOF,we have set our hands this day of 2016 <br /> APPROVED: _ <br /> RIC MBAU <br /> ATTEST: <br /> �O <br /> DENISE JOHNSTON,-E-RK <br /> APPROVED AS TO LEGAL FORM: <br /> TIM MEITZEN,CITY ATTORNEY <br />
