ORDINANCE NO. <br /> AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR <br /> OTHER PURPOSES. <br /> WHEREAS,the Batesville Planning Commission, after conducting a public hearing on September <br /> 27,2016, has voted to recommend that certain property be rezoned from Single Family Residential [R-1] <br /> to General Family Residential [R-2]; and, <br /> WHEREAS,the Batesville Planning Commission has evaluated said proposed amendment to the <br /> zoning districts map and determined that it is in harmony with the Comprehensive Plan. <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS <br /> HEREBY AMENDED TO DESIGNATE THE FOLLOWING DESCRIBED PROPERTY AS <br /> GENERAL FAMILY RESIDENTIAL [R-2]: <br /> A tract of land being a part of the SE '/4, NE '/4 of Section 14, TON, R6W, in the City of <br /> Batesville, Independence County, Arkansas, more particularly described as follows: <br /> Beginning at a point being 498.5 feet South and 569.94 feet West of the northwest corner of <br /> said SE '/4, NE '/4 of said Section 13; thence N 69°52'27" E a distance of 300.67 feet; thence <br /> S 60°44'44" E a distance of 249.09 feet; thence S 62009'59" E a distance of 388.30 feet; <br /> thence S 71025'40" E a distance of 159.94 feet to the southwest corner of Lot 47, Big Pine <br /> Addition; thence S 18°34'20" W a distance of 50.00 feet to the north line of Lot 3 of said Big <br /> Pine Addition; thence N 71125'40" W along said north line and the extension thereof a <br /> distance of 250.95 feet; thence S 18°34'20" W a distance of 137.12 feet; thence S 18°34'20" <br /> W a distance of 137.12 feet; thence N 63'23'15" W a distance of 786.42 feet to the east line <br /> of the Bill Davis tract; thence N 01041'08" E along said east line a distance of 202.68 feet to <br /> the point of beginning. <br /> IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD TO <br /> BE INVALID,SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING PORTION OR <br /> PORTIONS OF THIS ORDINANCE. <br /> IT IS SO ORDAINED. p <br /> IN WITNESS WHEREOF,we have set our hands this day of ©�►` , 2016. <br /> APPROVED: <br /> RICK BAUGH, MAYOR <br /> ATTEST: <br /> DENISE JOHNSTON, CLERK <br /> 7L�� <br /> APPROVED AS TO LEGAL FORM: <br /> HY EN, CITY ATTORNEY <br />
