r <br />ORDINANCE #__21'I <br />AN ORDINANCE PROHIBITING THE DEPOSIT OF GASOLINE, FUEL OIL OR OTHER <br />FLAMMABLE OR EXPLOSIVE LIQUIDS IN DRAINAGE DITCHES WITHIN THE CORPORATE <br />LIMITS OF THE CITY OF BATESVILLE; PROVIDING PENALTIES THEREFOR; DECLARING <br />AN EMERGENCY; AND FOR OTHER PURPOSES. <br />BE IT ORDAINED by the City Council of the City of Batesville, Arkansas: <br />SECTION 1. It shall be unlawful for any person, persons, firm, company <br />or corporation to place or deposit or cause to be placed or deposited in <br />any storm drain, ditch, gutter or other drain, whether natural or artifi- <br />cial, that carries storm or other surface water within the City of <br />Batesville, any gasoline, fuel oil or other flammable or explosive liquid. <br />SECTION 2. Any person, persons, firm, company or corporation who shall <br />violate Section 1 of this ordinance shall be deemed guilty of a misdemeanor <br />and on conviction shall be fined in any sum not less than ten ($10.00) dollars <br />nor more than two hundred fifty ($250.00) dollars with each day of violation <br />of this ordinance being a separate offense of said ordinance. <br />SECTION 3. Any ordinance or part of ordinance in conflict herewith is <br />hereby repealed. <br />SECTION 4. If any section, sentence or portion of this ordinance is <br />for any reason held invalid or unconstitutional by any court of competent <br />jurisdiction, such portion shall be deemed a separate, distinct and inde- <br />pendent provision and such holding shall not affect the validity of the <br />remaining portions thereof. <br />SECTION 5. This ordinance being necessary for the prevention of health <br />hazards and for the protection of the city streets and highways and further <br />necessary for the protection of the health, safety and welfare of the <br />citizens of Batesville, Arkansas, an emergency is declared to exist and <br />this ordinance shall take effect and be in force from and after the date <br />of passage. <br />Passed and approved this <br />ATTEST: <br />Larry Williams, City Clerk <br />_1'41� day ofVV <br />1979. <br />Peyt Golden, Mayor <br />
