V� <br />ORDINANCE # 9 <br />AN ORDINANCE AMENDING ORDINANCE #614 § 1 AND 3, § 5.12.01 AND <br />§ 5.12.02 OF TITLE 5 OF THE BATESVILLE MUNICIPAL CODE PROVIDING <br />COLLECTION OF SOLID WASTE AND FOR A GARBAGE DISPOSAL TAX; DECLARING <br />AN EMERGENCY AND FOR OTHER PURPOSES. <br />BE IT HEREBY ORDAINED AND ADOPTED BY THE CITY COUNCIL OF THE CITY <br />OF BATESVILLE, ARKANSAS: <br />Section 1: That Ordinance #614 § Section 1 §5.12.01 of Title 5 <br />of the Batesville Municipal Code is hereby amended to read as follows: <br />"All garbage, waste, trash, tin cans and refuse in the City <br />shall be collected regularly by the employees of said City, <br />and no other person, firm or corporation shall be allowed <br />to collect said garbage, waste, trash, tin cans and refuse <br />except employees of the City. Provided that this Ordinance <br />does not preclude a person, firm or corporation from pro- <br />perly disposing of its own garbage, waste, trash, tin cans <br />and refuse at some location outside the city limits; Provided <br />further that it shall not be a defense in a lawsuit brought <br />by the city to collect the garbage disposal tax provided for <br />in §5.12.02 of this code that the defendant has disposed of <br />his own garbage, waste, trash, tin cans and refuse." <br />Section 2: That Ordinance #614 ss Section 3 §5.12.02 of Title <br />5 of the Batesville Municipal Code is hereby amended to read as follows: <br />"That whereas, the services provided for by this ordinance <br />are for the benefit of all citizens of the City of Batesville <br />and are necessary for the protection of the health and welfare <br />of the City and its citizens, a garbage disposal tax is hereby <br />established and is to be collected by the City. Said tax is <br />to be paid by the residents and occupants of each residence <br />and business located in the City of Batesville. The amount <br />of tax to be levied on a particular residence or business will <br />be determined by resolution adopted by the City Council." <br />Section 3: All ordinances or parts of ordinances which conflict <br />with the provisions of the within ordinance are hereby repealed. <br />Section 4: This ordinance being necessary for the safety, well- <br />being and welfare of the public, an emergency is hereby declared to <br />exist and this ordinance shall be in full force and effect from and <br />after the date of its passage. _l <br />Passed and adopted on this _day of` Uvrt 44Avl 1980. <br />Approved: i <br />Pe-ton6tolden, Mayor <br />Attest: <br />Larry Williams, City Clerk <br />
