ORDINANCE NO. AN ORDINANCE REZONING A TRACT OF LAND BEING ALL OF LOT FIVE (5) AND LOT SIX (6) IN BLOCK ELEVEN (11) AND ALL OF FRL. LOT THREE (3), FRL. LOT FOUR (4), LOT FIVE (5) AND LOT SIX (6) IN BLOCK TWELVE (12), AND A 20 FOOT WIDE VACATED ALLEY BETWEEN SAID LOT 6 BLOCK 12 AND LOT 5 BLOCK 11, ALL IN BYER'S AND NEELY'S ADDITION TO THE CITY OF BATESVILLE, INDEPENDENCE COUNTY, . ARKANSAS, R-3 RESIDENTIAL TO C-lA COMMERCIAL. WHEREAS, the owners of a tract of land being all of Lot Five (5) and s Lot Six (6) in Block Eleven (11) and all of Frl. Lot Three (3), Frl. Lot Fourj (4), Lot Five (5) and Lot Six (6) in Block Twelve (12), and a 20 foot wide vacated alley between said Lot 6 Block 12 and Lot 5 Block 11, all in Byer's and Neely's Addition to the City of Batesville, Independence County, Arkansas,, have requested the rezoning of said lots from R-3 residential to C-lA commercial and have made application for said rezoning in the proper manner; and WHEREAS, public hearings have been held by the Planning Commission for the City of Batesville after proper notice having been published for the time and in the manner required by law; and WHEREAS, the City Council for the City of Batesville has received reports and recommendations from the Planning Commission and after due notice as required by law, the council has heard all persons desiring to be heard on the question§ and has determined that the property's best use is commercial and that it should be rezoned C-lA and that other property owners in the area will not be adversely affected by the rezoning and that the general public interest and welfare will' not be adversely affected by said rezoning. NOW THEREFORE, BE IT NOW ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE: j d (1) A tract of land being all of Lot Five (5) and Lot Six (6) in Block Eleven (11) and all of Frl. Lot Three (3), Frl. Lot Four (4), Lot Five $) and Lot Six (6) in Block Twelve (12), and a 20 foot wide vacated alley between said Lot 6 Block 12 and Lot 5 Block 11, all in Byer's and Neely's Addition to j the City of Batesville, Independence County, Arkansas, should be, and they s hereby are, rezoned to the classification of C -IA commercial; (2) That this ordinance should be published one time in a newspaper having general circulation in Independence County, Arkansas. (3) That a copy of the ordinance duly filed by the City Clerk shall be filed with the Recorder of the County and recorded in the deed records of the county.
