"CA. <br />)l <br />ORDINANCE #,929 4;�p <br />AN ORDINANCE PROHIBITING THE DISCHARGE OF FIREARMS WITHIN THE CITY LIMITS <br />OF THE CITY OF BATESVILLE; PENALTIES FOR VIOLATION; AND FOR OTHER PURPOSES: <br />BE IT ORDAINED by the City Council of the City of Batesville, Arkansas: <br />I. It shall be unlawful for any person to purposely, knowingly or <br />recklessly discharge or fire or cause to be discharged or fired any fire- <br />arm including rifles, shotguns and handguns within the city limits of <br />Batesville. <br />2. It shall not be a violation of this ordinance if said firearm <br />is discharged or fired or caused to be discharged in order to scare off <br />or prevent the roosting of blackbirds or other birds in the city limits <br />provided that the Mayor or his designated agent has declared an emergency <br />situation to exist and the user of said firearm has obtained written <br />authorization from the Mayor or his designated agent to use the firearms <br />said authorization shall state specific times and dates on which the <br />firearms may be used for this purpose. <br />3. Any ordinance or part of any ordinance in conflict with the pro- <br />visions herein are hereby repealed. <br />4. If any part or parts, sentence or sentences of this ordinance <br />are determined to be invalid, that portion shall be deemed severed from <br />the remaining valid portions of this ordinance and those valid portions <br />shall remain in effect and valid for all purposes. <br />5. Any person violating this ordinance shall upon conviction thereof, <br />be adjudged guilty of a violation and fined in a sum not to exceed $100.00 <br />for each offense. <br />Passed and approved this //#- day 1980. <br />Mayor <br />ATTEST: <br />City Clerk <br />t n1 <br />
