q32- <br />AN <br />32 <br />AN ORDINANCE PROHIBITING THE SALE OF VEGETABLES, FRUITS AND OTHER PRODUCE <br />UPON THE CITY STREETS, SIDEWALKS AND PUBLIC PARKS EXCEPT THOSE ITEMS RAISED <br />BY THE VENDOR; PROVIDING PENALTIES THEREFOR; DECLARING AN EMERGENCY AND FOR <br />OTHER PURPOSES. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS: <br />1. It shall be unlawful for any person, persons, firm, corporation or company, <br />to sale vegetables, fruits, or other produce upon the city streets, sidewalks,; <br />or public parks except those vegetables, fruits and other produce that have <br />been raised by the vendor. <br />2. That any person, persons, firm, corporation or company violating this <br />ordinance shall be guilty of a misdemeanor and fined in a sum of not more than <br />Twenty-five Dollars ($25.00) nor less than Five Dollars ($5.00). <br />3. All ordinances and parts of ordinances in conflict with the provisions <br />of this ordinance are hereby repealed. <br />4. That this ordinance is intended to allow the city to regulate the orderly, <br />sale of vegetables, fruits and produce in out -door markets on city property, <br />prevent traffic congestion hazards, and promote the sale of fresh products <br />and this ordinance is necessary for the protection of the health, safety <br />and welfare of the citizens of Batesville, an emergency is declared to exist <br />and this ordinance shall take effect and be in force from and after the date <br />of passage. <br />PASSED AND APPROVED THIS t DAY OF <br />ATTEST: <br />LARRY WILLIAMS, CITY CLERK <br />Z24,V—, 1980. <br />xvt <br />MAYOR <br />M, <br />I <br />
