M <br />,%W <br />+ AW NOW <br />ORDINANCE NO. q33 <br />AN ORDINANCE REZONING CERTAIN PROPERTY IN THE CITY <br />OF BATESVILLE LYING IN SECTION 4, TOW14SHIP 13 NORTH, <br />RANGE 6 WEST IN INDEPENDENCE COUNTY, ARKANSAS. <br />WHEREAS, by Ordinance No. 930 the following described lands <br />in Independence County', Arkansas were annexed, to the City of <br />Batesville, Independence County, Arkansas, to -wit. <br />TRACT 1: Beginning at the intersection of the North <br />right-of-way line of Arkansas State Highway No. 25 <br />and the West line Southeast Quarter (SE4-) of South- <br />east Quarter (SE4-), Section 4, Township 13 North, <br />Range 6 West, thence along above said right-of-way <br />line in an easterly direction for a distance of <br />200 feet to a point; thence at .right angles to above <br />said right-of-way line in a Northly direction a distance <br />of 200 feet; thence at right angles to East described <br />course a distance of 200 feet to a point on the test <br />line of SE4 of SE'« of above described Section 4; thence <br />in a Southerly direction along said quarter section <br />line a distance of 200 feet to the point of beginning, <br />containing one (1) acre, more=- or less, except. mineral <br />rights. <br />TRACT 2: A part of the Southeast .Quarter (SE4) of <br />the Southeast Quarter (SE4) of Section 4, Township <br />13 North, Range 6 West, described thus: Beginning at <br />the intersection of the North right-of-way line of <br />Arkansas State Highway No. 25 and the West line of <br />the SE4- of the SE -14 of Section 4, Township 13 North, <br />Range 6 West; thence in an Easterly direction along <br />said right-of-way line a distance of. 200 feet +-n the <br />point of beginning of the land herein conveyed; thence <br />at right angle to said right-of-way line and in a <br />northerly direction 515 feet to a point; thence in an <br />easterly direction and parallel to said Iiighway right- <br />of-way line 422 feet; thence in a Southerly direction <br />and parallel to the West line of said SE4 of the SE4- <br />a distance of 515 feet to said right-of-way line; <br />thence Westerly along said Highway right-of-way line <br />a distance of 422 feet to the point of beginning of <br />the land herein conveyed, containing five acres, more <br />or less, EXCEPT mineral rights. <br />WHEREAS, the City Planning Commission of the City of Batesvi.11 <br />Arkansas, has recommended to the Batesville City Council that said <br />lands as annexed and as described above be zoned C-2; <br />WHEREAS, the Council has determined that the property's best <br />use is commercial and that the property should be zoned under the <br />classification C-2; and that the general public interest and <br />welfare will not be adversely affected by said rezoning. <br />
