SYSTEM HAVING EXTRAORDINARY CONCENTRATION <br />Ij OF' POLLUTANTS. <br />i <br />I <br />WHEREAS, the Utilities Commission of the City of f <br />i <br />Batesville, Arkansas is charged with the responsibility of <br />" operating and maintaining the Batesville Wastewater System in <br />it <br />i accordance with all applicable local, state and federal laws; <br />i' and, <br />l <br />i WHEREAS, the City of Batesville, through the Utilities! <br />i' Commission, is the recipient of a grant of funds from the United <br />I <br />States of America (Environmental Pollution Agency Project No. <br />C-05-0332-03) to finance in part the Batesville wastewater pump- <br />ing and treatment facility; and, <br />WHEREAS, a precondition for the payment of funds <br />ii <br />awarded under the above-mentioned grant is the establishment of <br />I; <br />municipal legislation to implement Public Law 92-500 and the <br />+, regulations promulgated thereunder, including 40 C.F.R. 35.901 <br />j et seq; and to establish a system of surcharge for discharge of <br />effluent of extraordinary strength into the wastewater system; <br />i <br />NOW, THEREFORE, BE IT ORDAINED by the City Council of <br />the City of Batesville, Arkansas: <br />I <br />1. All persons, corporations, or firms d=ischarging <br />wastewater into the Batesville sewer, system who meet either of i <br />the following qualifications: I <br />(a) Which discharge wastewaters into the <br />system for a time in excess of 15 continuous <br />minutes per day, which wastewaters have a <br />concentration equal to or greater than four <br />times the average B.O.D. (270 milligrams/ <br />ji liter) or equal_ to or greater than four <br />times the average suspended solids (270 <br />I; milligrams/liter) <br />I <br />i' <br />
