Q <br />AN O'nDITvE1NCE ZONING CERTAIN LOTS ON BROAD srP.f, RU 1 C3 TO R3; SPi CIFICALLY' <br />REP ALING ORDINANCE NO. `7' AND ALL OTHER CONFLICTING OR INANCES OR <br />PARTS THEREOF, DECLARING AN EMERGENCY AND I'OR OTHER PURPOSES. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS, AS <br />FOLLOIdS : <br />(1) Ordinance No.—!y4/ 6 rezoning Lots 8, 9 & 10 in block 1 of Maxfield's <br />Southern Addition to the City of Batesville, Arkansas, from R-3 classification <br />to C-3 Classification and reouirin- the erection of a privacy fence is <br />hereby repealed. <br />(2) That Lots 3, 9 and 10 in Block 1 of Maxfield's Southern Addition to <br />the City of Batesville, Arkansas, shall be zoned R-3 classification. <br />(3) That all ordinances or parts of ordinances in conflict herein are <br />hereby repealed. <br />(4) That Ordinance No. 9Z1 6 which was adopted by the City Council on <br />,25 day of November, 1980 will soon be and is now in effect; that the <br />owners and the agents of the owners have decided not to use this property <br />in the manner originally intended when rezoned by Ordinance No.9q (0; <br />that the owners, their a -rents and surrounding property owners are aware of <br />the now possible uses of this property and desire that it remain residential; <br />that if construction of a commercial establishment is cor:imenced prior to <br />this Ordinance's becoming effective there will be a commercial business in <br />a residential zone; that this ordinance is required to keep the neibhborhood <br />consistently residential without possible grandfather clause exceptions. <br />W71EREFORE, an e;.iergency is declared and this ordinance will becor_ie effective <br />from the date of adoption. <br />� /9� 1 <br />PASSED AND APPROVED this ) 3 day of ' <br />T IAYOR <br />ATTEST: <br />CITY CLERK I <br />
