Ift ORDINANCE N0, 53 AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE BIDDING ON THE PURCHASE OF THREE (3) TWENTY (20) FOOT HAUL -ALL TRAILERS, DECLARING AN ',IERGENCY AND FOR OTHER PURPOSES. WHEREAS, the Arkansas Energy Department has completed a study of Sanitation pick-up in the City of Batesville, Arkansas and has recommended that the City of Batesville purchase three (3) twenty (20) foot Haul -all Trailers designed for quick curb pick-up of trash and garbage; and, WHEREAS, there is only one company in the United States that manufactures or sales these type trailers; and, WHEREAS, the City Council of the City of Batesville, Arkansas, finds that thel recorunendation of the Arkansas Energy Department should be followed and that said recommendations are in the best interests of the City of Batesville and its citizens. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Batesville Arkansas, as follows: (1) That pursuant to Arkansas Statute 519-4425 the requirement of competitive bidding hereby waived in the purchase of three (3) twenty (20) foot Haul -All Trailers from Haul -All Trailers, Inc. (2) That the City Council finds that this is an exceptional situation warranting waiver of bidding due to the non -feasibility and non -practicality of bidding on an item which is manufactured and sold by only one company. (3) That all ordinances or parts of ordinances in conflict herein are hereby repealed. (4) That the City may purchase these trailers at a substantial savings if purchased now; that said savings is in the best interests of the City of Batesville; that the Arkansas Energy Department has recommended purchase of these trailers and immediate implementation of the Arkansas Energy Department recommendations is necessary for the promotion of the public's health, safety and general welfare.
