CM <br />ORDINANCE # q6- � <br />AN ORDINANCE PROHIBITING AN OWNER OR OCCUPANT OF REAL PROPERTY FROM ALLOWING <br />ANY TREE, SHRUB OR OTHER VEGETATION FROM PROTRUDING OVER THE CITY RIGHT -OF -MAY <br />WITHIN NINE (9) FEET OF THE SURFACE OF THE EARTH OR FROM OBSTRUCTING ANY <br />TRAFFIC CONTROL SIGNAL OR DEVICE, PROVIDING PENALTIES FOR VIOLATIONS THEREOF, <br />AND FOR OTHER PURPOSES: <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS: <br />Section 1: It shall be unlawful for any person, firm or corporation owning <br />or occupying a lot, yard or other real property within the City of Batesville, <br />Arkansas, to allow any tree, shrub or other vegetation to grow or protrude over <br />the city's street right of way within nine (9) feet from the earth or to, in <br />any way, hide or obstruct the clear view of any traffic control sign or signal. <br />Section 2: If after ten (10) days notice any person, firm or corporation <br />continuing to violate this ordinance shall be deemed guilty of a misdemeanor <br />and upon conviction thereof be fined an an amount not less than. Twenty -Five <br />Dollars ($25.00) nor more than Two Hundred Fifty ($250.00) with each day of <br />violation being deemed as a separate offense.
