I <br />BEFORE THE CITY COUNCIL <br />FOR THE CITY OF BATESVILLE, ARKANSAS <br />ORDINANCE NO. <br />An Ordinance rezoning the following described property <br />from R-1 residential to C-2 commercial: <br />A part of the Northwest Quarter of the Northeast <br />Quarter of Section 8, Township 13 North, Range 6 <br />West, described by metes and bounds thus: <br />Commencing at a corner 155 yards and 2 feet East <br />of the SW corner of the NW Quarter of the North- <br />east Quarter of said Section 8, witnessed by a <br />red oak 6 inches in diameter bears South 38 degrees <br />East 20 links and a red oak 6 inches in diameter <br />bears South 231-2 degrees East 15 links; thence East <br />233 1/3 yards to a rock witnessed by a red oak 3 <br />inches in diameter bears South 40 degrees East 12 <br />links and a red oak 3 inches in diameter bears <br />North 40 degrees East 6 links; thence North 155 2/3 <br />yards to a rock witnessed by a red oak 5 inches in <br />diameter bears North 81 degrees West 27 links and <br />a red oak 5 inches in diameter bears South 37 <br />degrees East 13 links; thence West 233 1/3 yards <br />to rock witnessed by a red oak 6 inches in diameter <br />bears North 54 degrees East 3 links, and a red oak <br />6 inches in diameter bears North 884 degrees West <br />17 links; thence South to place of beginning, <br />containing 72 acres, more or less. LESS AND EXCEPT <br />a part of the Northwest Quarter of Northeast Quarter <br />of Section 8, Township 13 North, Range 6 West, <br />described thus: Commencing at a point 155 yards and <br />2 feet East of the SW corner of NW4 of NEI of Section <br />8, Township 13 North, Range 6 West, witnessed by a <br />red oak 6 inches in diameter bears South 38 degrees <br />East 20 links, and a red oak 6 inches in diameter <br />bears South 231-2 degrees East 15 links; thence North <br />155 2/3 yards; thence East 62 yards; thence South <br />155 2/3 yards; thence West 62 yards to the point of <br />beginning, containing 2 acres, more or less. <br />WHEREAS, the owners of the above-described property have <br />i; requested the rezoning of said lots from R-1 residential to C-2 <br />commercial and have made application for said rezoning in the <br />proper manner; and <br />WHEREAS, a public hearing has been held by the Planning <br />Commission for the City of Batesville after proper notice having <br />been published for the time and in the manner required by law; <br />and <br />WHEREAS, the Planning Commission has recommended the <br />rezoning of said property from R-1 residential to C-2 commercial;. <br />and <br />WHEREAS, the City Council accepts the recommendation of <br />the City Planning Commission to rezone said property; <br />
