V001 140 ` ORDINANCE NO. 9 r� An Ordinance rezoning certain property in the City of Bates- ville, Arkansas, lying in Highland Addition and original City of Batesville, in Independence County, Arkansas. WHEREAS, the City Planning Commission of the City of Bates- ville, Arkansas, has recommended to the Batesville City Council that the following described lands lying in Independence County, Arkansas, be rezoned from residential to commercial property: Lots 1 and 2, Block 2 and Lots 3 and 4, Block 1, Original City of Batesville and Lots 1, 2, 3 and 4, Block 3 and Lots 1, 2, 3, 8, 9 and 10 of High- land Addition to the City of Batesville, Arkansas. WHEREAS, after due notices as required by law, the Council has heard all persons desiring to be heard on the question and has determined that the property's best use is commercial and that the property should be rezoned under the classification C-lA; that other property owners in the area will not be adversely affected by the rezoning and that the general public interest and welfare will not be adversely affected by said rezoning. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Batesville, Arkansas: Sec. 1. That the lands described herein shall be rezoned under the classification C-lA. Sec. 2. A copy of the ordinance duly filed by the City Clerk shall: be filed in the Office of the Recorder of the county and recorded in the deed records of the county. Sec. 3.
