V001 140 ` <br />ORDINANCE NO. 9 r� <br />An Ordinance rezoning certain property in the City of Bates- <br />ville, Arkansas, lying in Highland Addition and original City of <br />Batesville, in Independence County, Arkansas. <br />WHEREAS, the City Planning Commission of the City of Bates- <br />ville, Arkansas, has recommended to the Batesville City Council <br />that the following described lands lying in Independence County, <br />Arkansas, be rezoned from residential to commercial property: <br />Lots 1 and 2, Block 2 and Lots 3 and 4, Block 1, <br />Original City of Batesville and Lots 1, 2, 3 and <br />4, Block 3 and Lots 1, 2, 3, 8, 9 and 10 of High- <br />land Addition to the City of Batesville, Arkansas. <br />WHEREAS, after due notices as required by law, the Council <br />has heard all persons desiring to be heard on the question and has <br />determined that the property's best use is commercial and that the <br />property should be rezoned under the classification C-lA; that <br />other property owners in the area will not be adversely affected <br />by the rezoning and that the general public interest and welfare <br />will not be adversely affected by said rezoning. <br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the <br />City of Batesville, Arkansas: <br />Sec. 1. That the lands described herein shall be rezoned under <br />the classification C-lA. <br />Sec. 2. A copy of the ordinance duly filed by the City Clerk shall: <br />be filed in the Office of the Recorder of the county and recorded <br />in the deed records of the county. <br />Sec. 3.
