9M <br />nr .r <br />ORDINANCE NO. � <br />An Ordinance rezoning certain property lying in Highland <br />(Addition, in the City of Batesville, Independence County, Arkansas.! <br />WHEREAS, the City Planning Commission of the City of Bates- <br />Iville, Arkansas, has recommended to the Batesville City Council <br />that the following described lands lying in Independence County, <br />'Arkansas, be rezoned from residential to commercial property: <br />That part of Lots 2, 3 and 4, Block 1, South of <br />College Street; all of Block 2; Lots 1, 2, 3 and <br />4, Block 3; and that part of Lots 1, 2, 3, 8, 9 <br />and 10, Block 4, South of College Street; all in <br />Highland Addition to the City of Batesville, Ark- <br />ansas. <br />That portion of First or Church Street between <br />College Street and Boswell Street, that portion <br />of the north half of Center Street between St. <br />Louis Street and the east line of Lot 8, Block <br />4 of Highland Addition and that portion of the j <br />south half of Center Street between St. Louis <br />Street and the east line of Lot 4, Block 3 of <br />Highland Addition to the City of Batesville, <br />Arkansas. <br />WHEREAS, after due notices as required by law, the Council has;; <br />heard all persons desiring to be heard on the question and has de- <br />termined that the property's best use is commercial and that the <br />property should be rezoned under the classification C-lA; that <br />Dther property owners in the area will not be adversely affected <br />by the rezoning and that the general public interest and welfare <br />gill not be adversely affected by said rezoning. <br />NOW THEREFORE, BE IT ORDAINED by the City Council of the City <br />of Batesville, Arkansas: <br />Sec. 1. That the lands described herein shall be rezoned <br />under the classification C-lA. <br />Sec. 2. A copy of the ordinan(_:e duly filed by the City Clerk <br />shall be filed in the Office of t ,.e '_.='.acorder of the County and re- <br />corded in the deed records of the :::7unty. <br />Sec. 3. Through a clerical oversight the original ordinance, <br />No. 972, contained a misdescription of the property to be rezoned <br />and this ordinance should be entered to amend Ordinance No. 972. <br />
