Ordinance No. AN ORDINANCE REZONING A TRACT OF LAND BEING THE NORTH 2 OF LOTS ONE (1) AND TWO (2) AND ALL OF LOTS THREE (3) AND FOUR (4), ALL IN BLOCK 43 OF MAXFIELD'S THIRD ADDITION TO THE CITY OF BATSEVILLE, INDEPENDENCE COUNTY, ARKANSAS, FROM R-2 RESIDENTIAL TO C-2 COMMERCIAL. WHEREAS, the owner of a tract of land being the North 2 of LOTS ONE (1) and TWO (2) and all of LOTS THREE (3) and FOUR (4), all in Block 43 of Maxfield's Third Addition to the City of "Batesville, Independence County, Arkansas, have requested the re- zoning of said Lots from R-2 residential to C-2 Commercial and have made application for said rezoning in proper manner; and WHEREAS, public hearings have been held by the Planning Commission for the City of Batesville, Arkansas after proper notice having been published for the time and in the manner required by 'law; and WHEREAS, the City Council for the City of Batesville has re- ,ceived reports and recommendations from the Planning Commission and after due notice as required by law, the Council has heard all persons desiring to be heard on the question and has determined that the property's best use is commercial and that it should be ',rezoned C-2 and that other property owners in the area will not be adversely affected by the rezoning and that the general public .interest and welfare will not be adversely affected by said rezoning. NOW, THEREFORE, BE IT NOW ORDAINED BY THE CITY COUNCIL OF .,THE CITY OF BATESVILLE, ARKANSAS: Section 1: That the North 2 of Lots ONE (1) and TWO (2) and ,all of Lots THREE (3) and FOUR (4) in Block 43 to the City of s "Batesville, Independence County, Arkansas, should be and they hereby are rezoned to the classification of C-2 Commercial; Section 2: That this Ordinance should be published one time in a newspaper having general circulation in Independence County, Arkansas; ;i
