• ORDINANCE NO. 2010- ri' l AN ORDINANCE TO RE-ZONE PROPERTY LOCATED WITHIN THE CITY OF BATESVILLE, ARKANSAS AND FOR OTHER PURPOSES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS: SECTION 1: That from and after the passage of this ordinance, the following described real property situated within the city limits of Batesville, Arkansas, now zoned C-1, be, and hereby is, re-zoned to R-2 as more specifically set out below: A tract of land being a part of the NW1/4, NW1/4, of Section 23 and a part of the SW1/4, SWI/4, of Section 14, all in T 13 N, R 6 W, in the City of Batesville, Independence County, Arkansas, more particularly described as follows: Commencing at the Southwest corner of said Section 14; thence S 88 degrees 12'01" E 726.96 feet to the point of beginning; thence N 34 degrees 09'54" E, 343.54 feet to the south right of way line of Woodmont Circle; thence along said south right of way line, along a curve to the left, • said curve having a radius of 476.72 feet, an arc length of 91 .8 feet, and a long chord bearing and distance of N 88 degrees 58'47" E, 91.66 feet to the west line of the Eagle Mountain Assisted Living Center Property; thence along said Assisted Living Property the following; S 00 degrees 00'00" W, 294.82 feet; S 53 degrees 57'15" E, 240.69 feet to the west line of the First Baptist Church Property; thence along said west line, S 04 degrees 06'04" E, 210.82 feet to the Clouse Property; thence along said Clouse Property the following: N 90 degrees 00'00" W, 469.23 feet; N 04 degrees 37'19" E, 140.00 feet to the Griffin Property; thence along said Griffin Property, N 09 degrees 18'53" W 224.26 feet to the point of beginning. This tract contains 4.69 acres, more or less, and is subject to any and all easements, from C-1 to R-2. SECTION II: All ordinances and parts of ordinances and conflict herewith are repealed. IT IS SO ORDERED.
