low <br />ORDINANCE NO. <br />AN ORDINANCE AMENDING ORDINANCE # 797 AND THE BATESVILLE MUNICIPAL CODE <br />CHAPTER 10.28, SECTIONS 10.28.01 REGARDING THE REQUIREMENT OF A CONSUMER <br />DEPOSIT FOR WATER, SEWER AND GARBAGE SERVICES; PROVIDING EXCEPTIONS <br />THERETO; PROVIDING PENALTIES FOR VIOLATION THEREOF; DECLARING AN EMER- <br />GENCY AND FOR OTHER PURPOSES: <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS: <br />Section 1: From and after the passage of this ordinance a deposit of <br />$25.00 shall be required for water service, $25.00 for sewer service and <br />a deposit of $20.00 shall be required for garbage service. The deposit <br />will draw no interest. The deposit shall be made to that agency of the <br />city in charge of collecting the water tax, sewer tax and garbage tax. <br />Section 2: At any time should the person in whose name the deposit is <br />made, asks for a refund of the deposit, and be entitled to a refund of <br />the deposit, the city agency in charge of collecting the water tax, <br />sewer tax and garbage tax shall compute the persons water, sewer and <br />garbage bill and refund the difference between the deposit and the <br />water, sewer and aarbage bill if there is any. <br />Section 3: No city water service shall be connected or turned on at any <br />location until the deposits required in paragraph number one above have <br />been made as required by this ordinance. <br />Section 4: No person or business entity presently using the city water, <br />city sewer or receiving garbage service and have already complied v.,ith <br />existing ordinances shall be required to make a deposit so lona as they <br />remain at the same address. If such person or business entity moves and <br />acquires a new address, a deposit as required by this ordinance shall be <br />made. In such case, credit will be given for the amount then held as a <br />deposit. <br />Section 5: Whereas, the city is losing water, sewer and garbage revenues <br />jbecause persons are moving without paying their water bill, sewer tax and <br />garbage tax, and whereas the water, sewer and garbage deposits at present <br />are not sufficient to cover many delinquent bills; and whereas due ;:o <br />this the city has lost water, sewer and garbage revenue, an emergency is <br />hereby declared and this ordinance shall be in full force and effect from <br />and after the date of its passage. <br />Passed and adopted this 2 T/--1 day of A1,C-L , 1982. <br />APPROVED: <br />6 f <br />JIMSMRELL, ~MAYOR <br />ATTEST: <br />t <br />LARRY WILL AMS, CITY CLERK <br />
