,nuc` AX <br />ORDINANCE #��� <br />AN ORDINANCE ALLOWING THE MAYOR OR HIS DULY AUTHORIZED REPRESENTATIVE TO SELL <br />,!OR EXCHANGE MUNICIPAL SUPPLIES, MATERIALS AND EQUIPMENT WITHOUT COMPETITIVE <br />BIDDING; ESTABLISHING A MAXIIHUM AMOUNT WHICH MAY BE SOLD OR EXCHANGED; PROVID- <br />lING EXCEPTIONS THERETO; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS: <br />,!Section 1: Pursuant to act No. 28, section 7, of the Acts of Arkansas 1959, <br />�as codified as Ark. Stat. Ann. 19-4427, the Mayor of the City of Batesville, <br />;Arkansas or his duly authorized representative may sell or exchange any <br />!!municipal supplies, materials or equipment subject to the following sections <br />of this ordinance. ` <br />f <br />''Section 2: That the Mayor or his duly authorized representative may sell or <br />1exchange any municipal supplies, materials or equipment without competitive <br />;'bidding so long as the value of said municipal supplies, materials or equipment <br />;!to be sold or exchanged or item or lot to be disposed of as one unit of sup - <br />!plies, materials or equipment does not exceed the sum of $2,000.00. <br />';Section 3: That prior to any sale or exchange of any municipal supplies, <br />materials or equipment without competitive bidding as provided in this <br />:ordinance, the Mayor or his duly authorized representative shall certify in <br />;writing to the governing body that in his fair opinion the fair market value <br />`of such item or lot of items is less than the amount established by this <br />feordinance. <br />;'Section 4: That any ordinance or parts of any ordinance in conflict herein <br />!:are hereby repealed. <br />:;Section 5: That the parts of this ordinance are severable and if any part or <br />parts of this ordinance are declared unconstitutional or otherwise unlawful <br />!;then the remaining valid portions of this ordinance shall remain in full force <br />;;and effect as though the invalid, unlawful or unconstitutional portions thereof <br />j,were never made part thereof. <br />E <br />-Section 6: It is hereby found that the public interest will best be served <br />,by permitting the Mayor or his duly authorized representative to sell or ex- <br />;�change any municipal supplies, materials or equipment without competitive <br />!!bidding so long as their value does not exceed the sum of $2,000.00, for the <br />Treason that often times the publication cost of a notice to sell City property <br />;!would exceed the value of the property to be sold or would render the sale <br />uneconomical; that the ordinances now in effect impose an undue financial <br />;burden upon the City whenever small items of personal property of the City are <br />,'to be sold.
