BEFORE THE CITY COUNCIL OF BATESVILLE, ARKANSAS <br />Twenty-first (21st) Street South of <br />Reynolds Street <br />PETITION TO VACATE <br />UNUSED AND UNOPENED STREET <br />Come Robert L. Slaughter and Mary Slaughter, husband <br />and wife, and Clyde Keene, by their attorney, Steve Bell, and <br />pursuant to Act 17 of the Arkansas Acts of 1945, state for their <br />petition to abandon a certain street for nonuse as follows: <br />(1) That Petitioners Robert L. and Mary Slaughter are <br />i� <br />i the owners of the following described real property: <br />Lot 6, Block 13 and all of Block 14 of the <br />Fitzhugh Park Addition to the City of <br />Batesville, Arkansas. <br />That Petitioner Clyde Keene is the owner of the following des- <br />cribed real property: <br />Lot 5, Block 13 of the Fitzhugh Park Addition <br />to the City of Batesville, Arkansas. <br />(2) That said land described in paragraph 1 lies south <br />of and immediately adjacent to Reynolds Street. <br />(3) That as platted in the subdivision records of the <br />i <br />City of Batesville, Arkansas, Twenty-first (21st) Street, south <br />`f <br />of Reynolds Street, is a street having a fifty (5 0 ) foot right -of-! <br />way. <br />(4) That there has been no attempt to open this street <br />!i or to use it for public purposes and such street has not been <br />r' <br />actually used by the public for a period in excess of twenty-five <br />(25) years. <br />(5) That the Petitioners are owners of all lands which <br />abut the street hereinabove mentioned; that no other property <br />owner other than Petitioners will in any way be affected by the <br />jjvacation of such street. <br />P <br />fff (6) That the presence of the platted but unopened <br />I1 street on Petitioners lands greatly hampers the development and <br />use of such land without a corresponding benefit to anyone; that <br />the public interest and welfare will not be adversely affected by <br />the abandonment of such unopened street. <br />i <br />,a <br />
