<br />"AN ORDINANCE ADOPTING THE BATESVILLE ZONING CODE PROVIDING FOR AND'
<br />l!CONTAINING A STATEMENT OF PURPOSE, AUTHORITY AND JURISDICTION,
<br />iDEFINITIONS, GENERAL PROVISIONS, REGULATIONS AND RESTRICTIONS,
<br />!PROVISIONS CONCERNING NON -CONFORMING USES AND STRUCTURES, OFF -
<br />!STREET PARKING, DESIGNATING AN ENFORCEMENT OFFICER, PROVIDING FOR
<br />11PENALTIES, ISSUANCE OF PERMITS, ADMINISTRATION OF THE CODE AND
<br />liOTHER PURPOSES NECESSARY AND ANCILLARY TO ZONING; ADOPTING THE
<br />I1'ZONING MAP WHICH IS A PART OF THE ZONING CODE; PROVIDING FOR
<br />Ii AMENDMENTS THERETO; PROVIDING FOR PENALTIES FILING SEVERABILITY
<br />?!AND FOR OTHER PURPOSES:
<br />i!BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,
<br />ARKANSAS:
<br />;;SECTION 1: That the Batesville Zoning Code consists of both a
<br />lltext and map annexed thereto; that said Batesville Zoning Code
<br />lwas adopted, approved and recommended by the Batesville Planning
<br />°'Commission at a public hearing held on August 5 1982
<br />pursuant to
<br />lathe requisite public notices and certified to the Batesville City
<br />':Council for its adoption and approval; that said Batesville Zoning.
<br />';Code was presented to the Batesville City Council on November 23,
<br />'111982, and was returned to the Batesville Planning Commission in
<br />:!modified form for recertification; thereafter, on or about Novem-
<br />"ber 30 1982 the Batesville Planning Commission did again certify'
<br />ilisaid Batesville Zoning Code to the Batesville City Council as pre
<br />R!viously modified by the Batesville City Council; that said Bates-
<br />ville Zoning Code, as certified by the Batesville Planning Comm -
<br />,;fission, on November 30, 1982 and revised by the Batesville City
<br />;`Council at a public hearing on December 14, 1982, is hereby
<br />,,adopted, both as to text and map, in full.
<br />,,SECTION 2: That said regulations and map, the Batesville Zoning
<br />Code in its entirety, are adopted as a code pursuant to public
<br />!,notice as set out in Ark. Stat. Ann. § 19-2421.
<br />BISECTION 3: That triplicate originals of said code are on file in
<br />the office of the City Clerk of the City of Batesville, Arkansas
<br />;!and available for public inspection.
<br />;SECTION 4: Any person or corporation who shall violate any of the
<br />;provisions of the said Batesville Zoning Code or fail to comply
<br />therewith or with any of the requirements thereof, or who shall
<br />;!build or alter any building in violation of any detailed statement;
<br />,or plan submitted and approved hereunder, shall be guilty of a
<br />misdemeanor and shall be fined in a sum of not more than One Hun -
<br />;;dyed Dollars ($100.00). Each day such violation is permitted to
<br />jexist shall constitute a separate offense. The owner or owners of
<br />!Jany building or premises or part thereof where anything in viola-
<br />ition of these regulations shall be placed, or shall exist, or any I
<br />11architect, builder, contractor, agent, person, or corporation em-
<br />,;ployed in connection therewith and who may have assisted in the
<br />commission of any such violation, shall be guilty of a separate
<br />offense and upon conviction thereof shall be fined as hereinabove
<br />i$ provided.
<br />A SECTION 5: If any section, paragraph, subdivision, clause, phrase3I
<br />!ior provision of Batesville Zoning Code be adjudged invalid or held!
<br />:'unconstitutional, the same shall not affect the validity of those
<br />regulations as a whole or any part or provision thereof other than;
<br />'the part so declared to be invalid or unconstitutional.
